This is why some animals eat their young. Now the legendary comedian says shes ready for a reunion. But first here, the nightline 5. And number one is good evening, and tonight wrenching testimony from a young widow who witnessed the murder of her beloved husband. The first of four trials in an infamous carjacking case outside a mall in new jersey. On a night that turned from celebratory, to a nightmare. I saw him put the gun to dustins head, and i heard bang bang, ssh. Reporter chilling testimony as she recounts the moment her husband was murdered right before here eyes. And it was so fast. Reporter this week, the first of four men accused of this 2013 murder is on trial. What had been a good day became the worst day of jamies life. And the last day of dustin freedmans life. Reporter this man, 36yearold basseen henry, charged with carjacking, Unlawful Possession of a weapon and firstdegree murder. Prosecutors say he drove the getaway car. Hes pled not guilty. It was december 15th, 2013. Just days before christmas. Jamie and dustin were leaving the mall in new jersey, they just finished dinner to celebrate their anniversary, and the purchase of their new condo. We walked to the car. He opened the car door for me, as he always did. Reporter she got in and buckled her seat belt while dustin walked around the back of the car. She said she heard muffled conversation and thought her husband was making friends. I turned around and i saw dustin standing in the middle of a person, a man on each side of him. Reporter then seconds later, gunfire. I saw him put the gun to dustins head and i heard bang bang ssshh, and then the windows shattered of the car, and then, like in slow motion, it played out. I saw the taller the taller guy, i saw him walk around, and he opens the car door, he leans in, he points the gun at my head, and he said, get out of the [ bleep ] car, [ bleep ]. And i said, okay, im going, im going, im going. Reporter mall goers nearby also heard the shots. I heard, pop pop pop pop. So i ducked. Reporter the mall was put on lockdown. They said there was an emergency and nobody could leave the building. Reporter according to jamie, the two suspects ordered her to get out of the car. Within seconds they sped off with the freedlands range rover. The car door slams and they skidded out of there. I just knew when i turned around, i knew what i was going to see. What did you see . I turned around and i i turned around and i saw dustin laying there in a pool of blood. And i ran over to him and i i couldnt get my phone to work because i had just got it at the apple store, it was right when the thumbprint came out, and i thought it was so cool, and i couldnt figure out how to unlock my phone to call 911. So i leaned down, i was on the floor, covered in his blood, and he was covered in his blood, and i held my hand to his head and i was screaming, i was screaming, stay with me, stay with me. And i see his eyes and hes looking at me, and hes gasping for breath. Reporter an onlooker called 911. Jamie freedland waited in the parking garage, holding her husband in her arms, trying to keep him alive. When you were holding dustin, were you able to communicate with him . I was screaming, stay with me, stay with me. His eyes were following me, they were focused on me, he was blinking, he was gasping for breath. But i know he heard me, i know he heard me, but otherwise, he he could not talk, no. Reporter according to freedland, 30 minutes later, the ambulance still had not arrived. 911, is this an emergency . Yes, its an emergency. Im at the short hills mall parking lot. My husband has been shot. Reporter the ambulance was there, but unable to clear the low ceiling of the malls parking garage. Emergency responders had to use a gurney to bring dustin down. He was then transported to the hospital. The doctors then came up to me and told me that there was nothing else they could do. Shes a critical witness in this case, not just because she can provide the human side of the impact this had, but because she was there. Shes the eyewitness who saw it all happen. So shes important, both emotionally and in terms of actual testimony. Reporter shes filed a civil lawsuit against both the mall owners and the Security Company, claiming they didnt provide adequate security. If you invite the public to shop at your mall, you better make sure its safe. This mall didnt, and they need to step up to the plate and take responsibility. Reporter the mall attorney tells abc news, they dont comment on pending litigation, and the Security Company denies any wrongdoing, placing the blame on the four suspects. Here you have the defendant, someone who is accused of murder, talking about possible prison time for life. In the civil cases, youre talking about responsibility, money damages, and there it is the mall being sued. Reporter but security video shows dustin may have been the victim of elaborate planning. This footage released by jamies attorney allegedly shows the killers suv in the parking lot three days before the murder. Her attorneys say on this day, the suspects first stalk this white suv in their twotone suburban, before they appear to tail it out of the mall. My colleague sat down with retired nypd detective. So theyre testing security at this point . Yes. And theyre confident that they can do their carjacking whenever and however they want. Reporter now look at this video from the day of the murder. That lurking twotone suburban is back, parking next to a white car. Theyre hunters, and theyre looking for their prey. Reporter minutes later, with no shoppers in sight, the car is driven over to the next parking lot, where prosecutors say they find their target, the freedlands suv, and thats when, according to police, they take his life and his car. I just knew when i turned around, i knew what i was going to see. Reporter in this case, all four suspects are being tried separately. So this widow will potentially have to testify three more times as the rest of the accused see their day in court. And next here on the show, we turn to something entirely different. Reporter and a new set of rules that you wont find in most marriage manuals. If i were to go and have a secret romantic relationship and not tell carrie about it, that would be cheating in this relationship too. Reporter so tonight, jonathan gets to stay home while carrie flirts with ray in a bar. And holds hands with him at a restaurant. And yes, thats her wedding ring, still on her finger. For me, the idea of being able to be with two people at once always seemed like an impossible dream. Now that i get to be with two amazing people at the same time, it feels like a dream come true. I feel like the luckiest person in the world. Reporter so whats in it for the men . They get to see other people too, although they admit neither is doing so at the moment. I consider myself open to dating people. Im active on dating websites. I go through the world considering myself romantically or sexually available. Reporter ray says there are plenty of advantages. Its a loving relationship. I dont know if i were in a nonmonogamous relationship, how i would answer it any differently. Reporter but carrie says theyre not a true triad. Ray and jonathan are not in a relationship with each other. Reporter though theyre not opposed to the occasional hang out. Any relationship in which all partners agree that each may have romantic and or sexual relationships with other part nerds, which could range from friends with benefits, to open marriage. Nightline has delved into poly amory before. There was danny and john. Oh, yes, and melinda, who unlike carrie and jonathan and ray, actually all live together with their two kids. So if youre not a couple, what do you call yourself . Were a triad. Yeah, some people say triple. Reporter they say the sex is really good. In the very beginning, there was a lot more three people having sex together often. Reporter but so is the extra set of hands for childcare. Its not only about sex, its about family, its about working together as a team. Its about accomplishing your dreams. Reporter one of their dreams, having children, and they managed to do that all together too. Ella and oliver are just five weeks apart. Its one thing to have your relationship and have it exactly how you want it. But then to bring kids into your relationship, do you feel like its a healthy way to raise a family . A resounding yes for me. More breast feeding, more opportunities, more team work. I can double breast feed while melindas making food, and jon is, whatever it is. Theres just more parental support for the children. Reporter and then theres john and ian who also live together with their one child. What do you say to people who believe that your relationship and the way that youre living your life is wrong . Thank you for sharing your opinion. I mean, what else were not here to convert people and tell people that monogamy and wrong. Totally ve totally valid choice. Reporter and with the divorce rate hovering around 50 , whos to say these people might not have a point . Carrie jenkins has written a book, challenging the notion that love requires monogamy. But what about jealousy. I think every relationship can come with insecurity. Were humans and were never sure about our standing. Reporter we saw this play out again and again in our triads. Jaya has her two lovers, but how do the men feel about each other . Would you two be friends if it wasnt for her . I dont think wed be hangout buddies. Theyre very different. What do you think, john . Way too chatty. [ laughter ] reporter but in this threeheaded household, who takes charge . Do you consider yourself more the alpha dog in this family . Uh, yes. Well, jaya is kibnd of the alpha dog too. So what does that make john. John is somebody who gets fulfillment out of being in service, doing things for people. Reporter is it hard to share someone that you love that much . Yeah, it can be. It can be tough. Reporter five years later, jaya, john and ian are still together. And then theres what they say is the social stigma. Carries received loads of negative feedback. There is some sometimes vitriolic and mostly anonymous comments that i get. Reporter despite criticism, carrie and her partners say theyre committed to sharing their story, for other poly amorrous people who arent able to. People do need to understand and to see that this is a real way that people live. Reporter challenging stereotypes about love. I would like to be in my relationships forever.
