will be testifying before the fulton county grand jury. trump goes on to say he shouldn't and then he goes onto launch a number of other attacks against duncan. again, this grand jury presentation is expected to take up to two days. of course we're going to be on high alert for any potential indictment announcements today or tomorrow. and this is a sprawling case. this has been a 2 1/2 year investigation that was set off when donald trump made that phone call to brad raffensperger and pressed him to find the votes for trump to win the state of georgia. it's gone onto include the fake elector scheme, an harassment campaign against election workers as well as a voting systems breach in georgia, sarah. >> all right. thank you for all of that. i appreciate it. john? >> just a reminder, these were the election results in georgia in 2020. this was the margin between the two candidates, joe biden won by 11,779 votes.

thank you for that. back to you, ken, on the subject of who, and i know we don't know exactly who might be charged or who will be charged. we do have an idea of who might be charged in the target letters. we know big names like rudy giuliani, potentially, sidney powell, potentially, donald trump, obviously potentially. what about the fake electors, is there anything else? >> eight of them have gotten immunity, katy, so the rest of them potentially are liable for charges, and there's a number of people probably known and unknown in this case who are -- we may see some surprises. that's the interesting thing about a sprawling 2 1/2 year investigation, and what's deeply significant about it for me sitting here in washington, covering these justice department cases is that this is the case that donald trump, if he's elected president, cannot make go away. >> that's a very good point. you can't pardon yourself out of a state charge or a state trial.

happen, if there are still proceedings going on, the courthouse will remain open. what that tells us, nicolle, is that we are still -- the grand jury is very likely still in session and we could be watching for some sort of decision possibly later this evening. now, i also got another piece of guidance from a source who's familiar with the proceedings. we know that right now they're still hearing witness number 5 out of 10 planned witnesses that they planned to call. that's notable because i broke here on msnbc about 2 1/2 hours ago or so they were hearing witness number 5. they're still hearing that same witness. a little more than two hours later. so that tells me a couple of things. one, whoever this witness number 5 is he or she is important, has a lot to say. there are a lot of questions coming at this person. but it also raises the questions of what could the other presumably five witnesses have to say, who are they. we do know there are two people who are still waiting. george chidi, of course you've heard that name a lot. he's the independent journalist
