Again, S'Court Rejects Abacha Family's Request to Access Foreign Accounts

Alex Enumah in Abuja The Supreme Court for the second time dashed the hope of members of the late General Sani Abacha family, following the dismissal of another of their appeals seeking access to seized funds in foreign bank accounts of the late Head of State and some members of the family. The first appeal filed by Abba Sani, was dismissed by the apex court on February 7, 2020 for being incompetent and lacking in merit. The Supreme Court had in the judgment held that the suit was statute barred and as such liable for dismissal. The Abacha family had since 2004 filed different suits challenging the legality of a request by the President Olusegun Obasanjo administration for the seizure and subsequent transfer of funds found in foreign accounts belonging to the late General and some members of his family.

Supreme Court judgment: Abacha's relatives wanted to enjoy remaining loot - CACOL

The Centre for Anti-Corruption and Open Leadership (CACOL) has hailed the Supreme Court for refusing the request by Ali Abacha, a brother to the late Head of State, Sani Abacha, to unfreeze accounts traced to him and relatives of the late Abacha. The accounts are in Jersey, Liechtenstein, Luxembourg and United Kingdom, Switzerland. Last Friday, a five-man panel led by Justice Sylvester Ngwuta unanimously held that Ali Abacha’s case was statute barred as at April 2004 when it commenced at the Federal High Court in Kaduna. The lead judgment was prepared by Justice Kudirat Kekere-Ekun. Delivered by Justice Ejembi Eko, the apex court recalled that it dismissed a similar appeal in February 2020.

Punch Newspapers Sections Friday Olokor, Abuja The Supreme Court on Friday declined a request by a brother to the late Gen. Sani Abacha, Alhaji Ali Abacha, to unfreeze the accounts traced to him and relatives of the late dictator in the United Kingdom, Switzerland, Jersey, Liechtenstein and Luxembourg. The apex court, in a unanimous judgment of a five-man panel led by Justice Sylvester Ngwuta, held that Ali Abacha’s case was statute-barred as of when it was commenced in April 2004 at the Federal High Court in Kaduna. In the lead judgment prepared by Justice Kudirat Kekere-Ekun, but read on Friday by Justice Ejembi Eko, the Supreme Court held that having dismissed a similar appeal February last year in its judgment on an appeal filed by Alhaji Abba Mohammed Sani on behalf of the Abacha family, it had no reason to depart from its reasoning.
