After a local District Court judge issued what amounts to an eviction notice Monday, former Aspen mayoral candidate Lee Mulcahy said he’s giving up his standoff with the local housing authority and leaving town.
“We got a U-Haul … and we’re loading it up,” Mulcahy told The Aspen Times on Monday. “We’re moving out as fast as we can. The city attorney has defeated us and I am going back home to be with family in Texas.”

James Hogue, 61, was arrested Monday by Aspen police officers investigating a burglary and charged with parking illegally and stealing power from a nearby apartment building, said APD Sgt. Mike Tracey. Hogue was not taken to jail and, instead, issued a summons for trespassing and tampering, which are low-level offenses.
Aspen police continue to investigate the burglary, which took place inside the parking garage of an apartment building in the 200 block of East Cooper Avenue, Tracey said.

A court-appointed receiver acting on behalf of a defiant Mulcahy closed on the property at 53 Forge Road and sold it to APCHA for $990,558.20 on Wednesday.
Mulcahy and his 85-year-old mother, Sandy, have repeatedly stated that they will not leave the deed-restricted home they built, and violence will ensue if forced.
“I will defend liberty and freedom with my life,” he said Thursday, while adding there is ongoing litigation, his case is on appeal and he is filing an emergency motion to the U.S. Supreme Court to stay an eventual eviction.
