Secretary of State Jocelyn Benson, a Democrat,
has asserted the proposed package of bills is âmore restrictive than Georgiaâs.â
However, some of the proposed bills aim to prevent similar issues presented by a directive Benson issued last October, which directed city clerks to presume signatures were valid when matching absentee ballot signatures with the voter signature on file.
Although Bensonâs directive was followed while votes in the November 2020 election were tabulated, it was struck down last month by Michigan Court of Claims Judge Christopher M. Murray.
âThe presumption is found nowhere in state law," Murray wrote in his opinion. "The mandatory presumption goes beyond the realm of mere advice and direction, and instead is a substantive directive that adds to the pertinent signature-matching standards."

Last year, as Democrats across the country implemented last-minute rule changes ahead of the November election, Benson issued a directive that local clerks count with a presumption of validity.
“Signature review ‘begins with the presumption that’ the signature on an absentee voter ballot application of envelope is valid,” Benson ordered in October. Only ballots signed with “multiple significant and obvious” inconsistencies ought to go under further review.
Detroit-area Judge Christopher M. Murray, however, ruled last week that Benson’s order violated the Michigan Administrative Procedures Act (APA). Murray argued Benson’s instructions were “rules” passed without following the proper procedures in place.

FLINT, MI -- A federal judge heard early defenses and criticism of a proposed settlement of Flint water crisis lawsuits Monday, Dec. 21, and told Flint residents she will take as long as necessary to hear any comments they have before giving final approval to the deal -- even if their testimony takes several days to complete.

Michigan Attorney General Dana Nessel plans to fight a court determination that businesses may, under state law, choose not to serve customers who are gay.
State Court of Claims Judge Christopher M. Murray in a summary judgement this week ruled that Michigan’s definitive anti-discrimination law, the Elliott-Larsen Civil Rights Act of 1976 (ELCRA), doesn’t include protections for sexual orientation. The same ruling found that it does, however, protect based on sexual identity.
