could happen between now and may of 2024 and trump's lawyers will no doubt try to use every delay tactic in the book to draw out the legal proceedings. but apart from that, there are practical questions about how this trial actually take place. will trump as a former president and current presidential contender gain any special considerations from judge cannon? and how the breakneck pace of the campaign impact how trump stand trial? i can't think of anybody better to dig into these questions and neil cattle, he's a former acting solicitor general and msnbc legal analyst. i have so many questions but i want to start just kind of with the timeline of this. i know you have said that there is no reason for a delay, but there's also every reason to think the trump's legal term wants to delay the process. i mentioned some of them a what tactic are you going to be watching for that you expect they might try to deploy? >> first of all jim, i think that donald trump had a really terrible week, not just because

a ton of different motion throughout the course of discovery that would naturally push a trial further. and as attorneys -- we expect that to be the case throughout the course of a case like this. not just that -- but, when you are talking about may of 2024, the primary season is all but done at that point. so, donald trump is the nominee. at that point, it gives new life to this argument about election tampering or election interference, potentially because, right now, it's far too early for a judge to consider. that >> kristy greenberg, to throw yet another wrinkle in here, maybe this is a delay tactic. but today on fox, trump's newest attorney, john lauro said that the first thing he would ask for in trump's case was cameras in the courtroom. now, tell the audience, our cameras allowed in the courtroom in federal trials? >> so, they can be. they can be. if there's an order from the judge allowing them, they can be, particularly in high profile cases that are of intense public interest, which

consider. that >> kristy greenberg, to throw yet another wrinkle in here, maybe this is a delay tactic. but today on fox, trump's newest attorney, john lauro said that the first thing he would ask for in trump's case was cameras in the courtroom. now, tell the audience, our cameras allowed in the courtroom in federal trials? >> so, they can be. they can be. if there's an order from the judge allowing them, they can be, particularly in high profile cases that are of intense public interest, which this is. so, i have to say, i think this is a great thing. i think it is great for transparency. i think it's great for the american public to see what is going on in that courtroom. >> how likely is it, though, that the judge will grant that? the -- judge -- >> well, it is kind of a case, it's going to be tough. because this is all involving classified materials. >> right. >> and so what can be made available to the jury's may be different than what may be available to the public. and so, there is going to have

whereas i think judge cannon is more likely to give him bits and pieces, delay here, delay there, and then you turn around, and it's already past the election. essentially it's death by a thousand paper cuts. but trump may be overplaying his hand by asking judge cannon to go ahead and delay this thing indefinitely. i don't think he'll get that. if judge cannon grants that, i think she'll be reversed by the 11th circuit and possibly even taken off the case. >> interesting. as of thursday, both trump and walt nauta, their attorneys had not taken necessary steps to apply for security clearances to review documents for that case. i mean, what does that say about the effectiveness of their counsel, or can you just read between the lines and see some of this as delay tactics? >> i think it's a delay tactic. i mean this is trump's m.o. i mean the fact that he's even saying that, let me argue that the presidential records act allows me to keep these

elliot? >> i too have done fs-86s throughout my government career. i agree with your point. they are voluminous, and you have to pull every piece of information. but my question for you as someone who has represented the former president, and you didn't quite answer this with anderson, do you think this is just a deliberate delay tactic? it certainly should be a priori briefed up and get ready and fill out their background checks in order to zealously represent their client. it's really a sincere question. do you think they really might just be trying to delay this and push this out rather than it's a hard document to fill out and takes time. i just don't think it's that convincing if that's the argument they're making. >> i think that the bigger indicator is the fact that they filed a motion asking for the trial to be discontinued without any date whatsoever. that's the bigger -- >> that's the red flag for you. >> what the strategy is.

got to pull every piece of information. but, my question for you, as someone who's represented the former presidents. and you didn't quite answer this with anderson. do you think this was just a delivered delay tactic? it certainly should be a priority, foreign attorney to get briefed up, and get ready, and fill out their background checks in order to be able to zealously represent their client. and, i guess it's really a sincere question. do you think they really might just be trying to delay this and push this out, rather than, oh it's a hard docking to fill, and it takes time. i mean, i just don't think that's that convincing, if that's the argument they're making. >> i think that the bigger indicator is the fact that they filed a motion, asking for the trial to be just continued without any date whatsoever. that's the bigger. >> that's the red flag for? you >> what the strategy, is yes. >> -- and, i mean the truth is, if the two attorneys who filled it out are the two that are actually going to be reviewing those documents, then that's fine. i mean, back with the old team, jim trusty and i, we both have

nauta lawyers moving on their own. it pushes things back just a couple of days, but ultimately that gets into the crunch time as campaign picks up for real. >> and at that point, i'm sure we will see trump himself asking for motions to continue. because he has rallies for older primaries to attend. and that is when we really will find out whether the justice system here is up to the challenge of trying a former and would be future president. >> kyle, the filing today from jack smith made quick haste with pointing out problems with walt. these attempts to be able to delay these hearings, one of which is that none of nauta's lawyers or security clearance, is it just another delay tactic on the part of nauta? >> i think it's true. i think he hasn't yet completed the paperwork to get his clearance to review the classified evidence and the doj, as part of this aggressive

with pointing out problems with walt nauta's attempts to delay the hearing. one of them was nauta's lawyers security clearance, or lack thereof at this point. what do we know about that? is it just another delay tactic on the part of nauta? >> i think it's true. i think stand woodward has not yet completed the paperwork to get his clearance and review the classified evidence, and have the doj as part of this aggressive timeline that they have set for the december trial. they need the trump and nauta attorneys to have clearance, at least interim clearances so that they can look at these large volumes of classified evidence that occurred in this case. they have already said that as soon as they get the file for these clearances, we have a mountain of classified materials that we can show them right away where they can start reviewing it and come up with the defense strategy. until stand with where it gets that in interim initial clearance, not even a permanent clearance, just a first step.

light on, it's also a possibility. i think as everything comes by, his value diminishes. >> so barbara, this is of course the third attempt to actually rain mr. nauta because he had retained legal counsel that could work there in florida until yesterday, and that led some to suspect that that is a delay tactic, that is the first of many perhaps that trump's side is going to utilize. i want to get your take on that. going forward here, we know this is a complicated case. we know the classified materials are evolved and that will slow things down. how do you see this playing out? do you think that this case will start in the december trial date that they currently have? >> i don't know about the december child it but is it a little bit ambitious. i think we will learn a little bit more next week when the parties going to visit with the court for a -- classified information procedures act. they are going to work through how they deal with discovery and emotions and trial and

frankly, i think it is part of a generalized delay tactic for him. it could be understandable if he can't help someone to help him pay his bill. i don't think he will have any problem helping someone help pay his bills. i can't imagine what the hold-up is here. at some point most judges will slightly run out of patience at that. you get a couple bites at the apple here. when it is going on later in the month, just go get counsel. obviously he does not qualify for appointed counsel. it shouldn't be this hard. >> yeah. and his current lawyer is paid through a trump-paid pac. if he decides to cooperate against the former president, he will have to find a new lawyer. what do you think of the odds of going to trial. it is being delbated whether it will happen in december. >> no. even without this ticking clock,
