Man charged with fatal shooting in Austin

Adobe Stock Photo A 24-year-old man has been charged with a fatal shooting last summer in Austin on the West Side. Davonte Brown faces a count of first-degree murder, Chicago police said. About 5 a.m. on Aug. 22, 31-year-old Devon Nelson was found unresponsive outside with a gunshot wound to the head in the 100 block of North Mayfield Avenue, according to police. He was taken to Loyola University Medical Center in Maywood, where he was pronounced dead. Following an investigation, Brown was arrested after being identified as the person who fired shots at Nelson, police said. Brown was expected to appear in court on the charge Sunday.

two men were captured immediately, orlando cart and nathaniel sims. according to there court affidavit, the getaway driver disappeared into therapy hope elementary school. law enforcement sources say when officers chasing the driver got inside the school, they encountered the teen with his hands in the air. they took him into custody and waited for the sergeant to come and make a positive id. she did, and the teen was charged. but sources say investigators now believe the teen put his hands in the air because he had walked away from the division of youth and rehabilitation services. he thought the police were coming to him. the ten people killed that night were shot over a back and forth street war. orlando carter killed a man over a bracelet. when orlando carter was shot the next day, carter went looking for pay back recruiting help and arming himself with an ak 47. here outside police headquarters, emotions are running quite high. there are family members of some of the victims that are here. they have brought photographs, they are very upset. in fact, we saw one family member screaming at someone from the united states attorney's office here today. part of the problem is that a newspaper here in town identified this teenager. his name is out there. but now that the charges are dropped against him, there is some concern that his life may be in danger. back to you. paul, let me ask you. the ak 47 apparently used in the attacks, are investigators still operating under the theory that that gun was thrown from the getaway car? >> reporter: oh, absolutely. they have a witness, a police officer who saw the gun come out of the car. it actually landed on the hood of the police car, hit the windshield and dropped to the ground. an officer coming up from behind picked up that weapon and we know from a preliminary hearing that that weapon has been positively identified as the weapon used in the shooting. ballistics tests say that. it and was -- and it was also used in the murder of jordan howe. >> that press conference expected to happen within just a few minutes. we'll bring it to you as soon as it happens. a wild scene overnight outside a club in prince georges county. a deputy hit by a car. a fire started outside club elite on brinkley road. the sheriff's department says two off-duty deputies providing security at the club tried to break up a fight. three suspects then got into the car and hit one of the deputy. both deputies fired at the car hitting the driver. the deputy was also hurt, but not seriously. the driver is expected to recover. we are following a developing story in the district right now. the driver accused of causing a deadly accident just faced a judge. police say he crashed his van head on into a car, killing a woman and injuring several children. it happened monday on alabama avenue. john, what have you learned? >> reporter: sean, we know now that witnesses have told detectives that the van was driving on the wrong side of alabama avenue for a substantial distance before it smashed into that sedan. carrying five people. we know the 37-year-old woman who died was the mother of the children. some of the children were terribly injured. a two-year-old was ejected because of the force of the collision. by the way, police investigators believe that van was doing about 52 miles per hour just before the crash. a jenny jones, 34 years old is charged in this case with second degree murder. we also know, according to the police documents, released in court, in testimony in court today, that a blood sample taken from jones after the accident showed pc pin his bloodstream. the defense, public defender sonnen berg use that had pc pin the blood. she argued second degree murder should not be on the table. she said it requires intent. she said if her client was intoxicated, maybe he didn't have the intent. the judge said just because there is pc pin his blood doesn't mean he was completely out of it. i'm not giving you this on a preliminary hearing. so magistrate judge milton lee denied that motion. second degree murder remains the charge for now. and he denied bond. jones is staying in jail for the time being. a hearing in back to you. john, thank you. you can expect plenty of traffic tie ups this weekend thanks to major road closures for the world bank meetings. these streets close around 7:30 friday evening. there is no parking on those streets starting friday, but the times will vary. signs are posted alerting drivers about the parking restrictions. the economy could force another rate hike for metro riders. the intindividual manager, richard sorelles, is pushing rate hikes, but cutting back on some of the proposed service cutbacks. he wants to raise metro rail fares by about 15% and charge an extra 10 cents during the busiest of rush hour times. those would be in effect from 7:30 until can in the morning. bus fares would go up about 20% to $1.50 for anyone using a smart trip card. rail service would end at 2:00 a.m. on weekend nights instead of the current 3:00 a.m. much of the public feedback indicated passengers would be willing to pay more to keep service. president obama traveled to new york to make a pitch for financial reform. his message to wall street pretty loud and clear. get ready for more regulation. the president is urging lawmakers to pass reforms and soon. republicans are taking issue with at least part of the bill. fox's craig boswell is following this one tonight. >> reporter: president obama pressed wall street to support a sweeping overhaul of the nation's financial regulatory system. at the same time pushed lawmakers to act. >> but i believe we and must but this kind of cynical politics aside. >> reporter: a difficult request, as the battle over financial reform legislation rages on. democrats offering harsh words for the republican criticism of the legislature. >> the minute these things come out of the mouths of our republican colleagues, we rebut them. >> reporter: on the senate floor the two sides briefly skirmished over taking up the legislation. >> i will object. here we go again. >> reporter: gop leaders who say the legislation will lead to more taxpayer bailouts want to wait for ongoing closed door negotiations to resolve differences in the bill before bringing it to the floor. >> here we go again. >> reporter: still developing story. >> reporter: the explosion happened at the deep water horizon rig tuesday night about 50 miles off the what la coast. the rig under contract with oil giant bp. workers were doing exploratory drilling at the time and not really in production. >> our focus has been in supporting the coast guard, and the transocean search rescue and providing medical support for the injured. reuniting the other evacuees with their families as quickly as possible. survivors pulled from the burning rig are being reunited with relatives. family members of workers anxious to hear any news that trickles in. >> the oil industry a big part of the community, here. fellow rig workers know the dangers of the business. >> we are just lifting the families up in prayer and keeping them in continue to follow breaking news out of the district. an arrest in the case of a deadly drive-by and charges being dropped against a teenage suspect already in custody. paul wagner is live outside dc headquarters with the very latest. we know we were waiting on a press conference. what is the latest with that? >> well, a little fly in the ointment. ten minutes past 5:00 a he want ptive -- a reptive from the mayor's office came up to the podium and told reporters they wanted to move the news conference upstairs that. got family members of some of the victims in the south capital street shooting very, very upset. because they wanted to hear the officials talk. we understand that dc police chief cathy la near is expected to come out, as well as peter nichols, the attorney general. we have been waiting for them to come out. what happened then is the mayor's office then removed the pod ium and they took it away. and all the reporters here said we are not going inside, we are going to stand by the families that want to hear the information coming from peter nichols and chief la near about the dropping of the charms and the additional arrest. we stood our ground and a couple of minutes ago a spokesperson for the chief came out and said now that they had acquiesced and they will now come outside. we are told we will have a news conference here outside in front of police headquarters. paul, thanks for the update. let us know when they come out. we will come right back to the press conference live. sky fox over the end of a day long search at dulles. a dog that went missing was loaded into the plane. it was a specially trained dog with the army from norway. he escaped from his crate last night. karen gray houston is live at the airport where the authorities located the dog a short time ago for the second time. >> it sounds like a cat and mouse game out there. >> reporter: will, this is a crazy story. needless to say the handler is thrilled. she is just glad to have her dog back. the dog is a 20-month-old male doberman. his name is condo. he was in the united states for special training, and if he has learned anything, it is how to dodge authorities looking for him. missing nearly 24 hours, and after he was found the first time, about 3:00 in the afternoon, condor seemed cool and a cucumber. >> he seems okay, perfectly fine, his handler is a captain in the army of norway, here to get special training for condo and his military companion, cuba. somehow last night condor slipped away. >> i'm not sure how he got loose. he was being packaged to travel with his owner. >> reporter: then the search was on. the handler and the airport ops team searched the tarmac and the 12,000 acres of undeveloped land on the grounds of dulles. there were some sightings. >> he was found 50 yards away from the place he was spotted this morning. >> reporter: during the search, inside the terminal, passengers already frustrated about delays were surprised to learn a dog was missing. >> really? interesting. well, at least that spices up our trip a little bit more. >> reporter: should anybody be concerned? >> no. why? >> reporter: it is a doberman. >> oh, yeah. probably. >> reporter: we did notice after condo was found and crated up again, he didn't seem to like that crate one bit. just when we thought the story was over with a happy ending, condition dore -- condor escaped again. >> he was being wheeled out onto the tarmac when he got away again. this time they found him about a mile away in a grassy area by the runway. he is back in custody now, and will, this just makes me wonder if dogs have a sense of humor. what do you think? >> well, as a dog owner, i think they probably do. karen gray houston, thank you. we want to take you back to the big story we are following tonight. we have more now on the deadly drive-by shooting in the district. >> the press conference is happening right now outside dc headquarters. >> reporter: we want to thank everybody for their patience. >> it has taken the police department a lot of time to do their excellent work. one, it was march 30 of last month, when washington, d.c. experienced one of the most violent crimes that has ever happened in the city. gone from us, devon nelson, william jones, rochelle jones, devon boyd. five other surviving victims from that night, whose names we continue to keep confidential. but as i have heard from the minute the city found out about this tragedy, that without any question, the hearts of all the residents of the district of columbia go out to the parents beside me, to the families all over the city, to friends who knew them. the second thing that i'll say, what also became pretty apparent after the homicide, was that our police department had done some amazing work in bringing some bad guys into justice. that in only what can be described as a high speed chase, putting their own lives on the line and a sense of urgency, second to none, the police department chased down and arrested bad guys and brought them into justice. the great thing about this police department is that they have never once, since those arrests, stopped investigating every aspect, detail and circumstance of what happened on march 30. which brings us to today's announcement. today the chief of police will announce significant progress in bringing to justice the people who are involved in the march 30 shootings and homicides. before the chief talks about in detail, there is one particular.of clarification that needs to be made. about one of the individuals who is arrested that night, to do that, i'll turn it over to the attorney general for the district of columbia. don't forget, it is the attorney general's office that has jurisdiction over youth offenders in the district of columbia. after the entire press conference is over, i think everybody will be clear, hopefully crystal clear about the level of involvement of everybody arrested on march 30, and everybody who is either arrested today, or who will be arrested in the very near future. attorney general? i think the bottom line is that the charges against may leak carter have been dismissed. the facts giving rise to my authority to talk about malique carter, which allows me to talk about the charges, that this particular individual, a juvenile in our system, has been exonerated of the charges. how did it happen? ever since this tragic event, we, in the attorney general's office and the police department have been looking closely at the facts. there were facts at the time, and circumstances, that gave rise to probable cause to arrest malique carter. and those facts were presented to a court, and the court found probable cause. but that is not the end of the matter for the attorney general's office, and for the police department. we continue to pursue leads. we continue to interview witnesses. and what happened here, as the investigation progressed, there was significant development among the witnesses, in terms of the interviews and what they were saying about what happened on that tragic day. and yesterday, we received fingerprints that absolutely cleared malique carter. immediately, we filed a motion with judge jackson, asking that we be permitted to tell the community and tell the media that mr. malique carter had been exonerated by the evidence and that we were dropping charges. so i stay very close to what i have been authorized by the court to say, i want to read from the court order, and i will provide the court order to those of you who who wish to have it, as well as the motion we filed this morning, seeking permission to talk about the circumstances that gave rise to this decision. the judge wrote, judge jackson, the government and council for the respondent are seeking permission from this court to publicly discuss the circumstances surrounding the respond dent's arrest and subsequent dismissal of all charges. the respondent was arrested on march 30, 2010, and charged with being involved in a mass shooting in the district of columbia. subsequent to his arrest, and let me add, contrary to stipulations imposed by the court, the washington examiner, and several published articles, specifically identified the respondent, mr. carter, as being involved in the shooting. that is not allowed under our law. further investigation by mp.d. and the office of the attorney general has produced evidence that the respondent was for the the driver of the vehicle that was alleged to have been involved in the shootings. indeed, the fingerprint evidence that we received yesterday demonstrated to us in conjunction with the witness statements we had that the charges should be dismissed. and the second paragraph, and very important as to why the court thought it appropriate to give us permission to talk to you today, the public disclosure, which was unlawful, of the respondent as being involved in this crime has publicly labeled him as being involved in a serious crime and potentially compromised his safety. for that i apologize. in a perfect world we would never have mistakes. the circumstances leading to the probable cause hearing were such that both we and the court believe there was probable cause at that time to hold mr. carter. the respondent could face retribution for his perceived role in this offense. in addition, without a full explanation that he was not the driver of the vehicle, there may be speculation that he is a witness for the government. publicly announcing, which i am doing today, the dismissal of charges and the reason for the dismissal, would clarify the public record as to the respondent's involvement, and help insure the respondent's safety. so the court has authorized to make the statement with a limited purpose, i'm quoting the court, of correcting the public record. the attorney general has given one part of what will become very clear, that the police department believes that they have, without a shadow of a doubt, everybody who, all the names and all the information and significant arrests of all the people who were involved in the march 30th shooting. as you listen closely to chief la near's report, of the activities of the police department, which is extensive of bringing further people into custody, chief? >> let me try and clear up i guess the rest of the gap that needed to be filled in here. on the night of the 30th, immediately following the shooting, officers in the seventh district immediately got behind the vehicle that carried the shooters and pursued that vehicle and an extensive pursuit that traveled in and out of the district of columbia. these officers, in the course of this pursuit, knowingly chasing a vehicle full of armed gunman who opened fire on a public street stayed with that vehicle through the course of pursuit, during which time there was multiple opportunities and in fact during the pursuit, five of my officers were injured and transported to the hospital, to stay with this vehicle and make apprehension of those in that vehicle. at the end of this pursuit were intentionally rammed by the vehicle full of gunmen and bailed out. the officers heroically pursued those individuals in the van and made apprehension of three people. in the course of that apprehension, the apprehension of malique carter, malique carter was arrested that night at the time of the arrest, did, in fact, have an open custody order, and was arrested and charged with that custody order that night. over the course of the next several days, working with the courts, with the attorneys office, probable cause was developed, and charged, days later were placed based on that probable cause. in an ideal world all the witnesses involved would have come forward and given us statements that night. they didn't. over the past several weeks, additional witnesses have been developed and as we develop additional witnesses, we have to go back and verify what they tell us and we have had additional witnesses, what i have said for three years now, who are doing what they should do, come forward and give us information and we have had to run that information down. it has been extensive investigative efforts by the members of the investigative department of the police department, the oeg, and the attorney general's office. final decisions are made. this is how the justice system works. i wish i could say that news organizations, in want to go get information out, would have been a little more patient with us. and not, in some cases, reported the names of individuals prior to. you are listening to dc police chief cathy la near. we also heard from the attorney general peter nichols. the big headline is 14-year-old malique carter has been exonerated. it is really a lesson in the process to some extent. probable cause was developed. he was arrested and charged, the court agreed. now based on fingerprinting just uncovered by investigators, malique carter has been exonerated, the charges dropped. >> that's right. you may remember originally police said they thought the 14-year-old malique carter was driving the get away van from the alleged drive-by shooting. they are now saying he was not involved at this time. we are going to stay on top of evening. temperature-wise. not bad. around 70 degrees for hagers town. we'll get a little cooler going into the weekend. but i don't think we are talking any 50s for awhile. clouds tonight, 58 degrees. s mostly sunny to start the day tomorrow and we will have an increase in high clouds. we have a nice warm up again for tomorrow. temperatures right back up into the 70s. lower 70s for most of us. farther to the north, it will be in the 60s and farther to the south it will be more in the middle 70s. in comes this next storm system that will bring us some showers on saturday. but more likely most of this is coming in on sunday. we can have thunderstorms too. nice and mild tomorrow. again we start off in the lower 50s. we are up to 65 degrees at lunch time tomorrow. we'll round out tomorrow with temperatures in the lower 70s. what you'll notice tomorrow is you'll start off with lots of sunshine. you'll end up with overcast conditions late in the day. spotty showers and cooler for saturday. most of the rain comes in saturday night and sunday. thunderstorms too and then we stay unsettled for the next several days. >> that is your forecast. back over to you guys. thanks,
