and on the same day, judge tanya chutkan is expected to set a trial date in the federal elections case. joining us now with more is msnbc legal analyst lisa rubin in atlanta, and gwenn keys fleming, former district attorney in dekalb county, which neighbors fulton county, the co-author of the brookings institution report fulton county georgia's trump investigation. so, lisa, i want to start with harrison floyd who had his hearing this morning. what do we know happened? >> we don't even know if that hearing did happen. here's why. our field producer inside spoke with fulton county superior court judge scott mcafee who said that harrison floyd remains at the jail today because he hasn't posted bond, that he's entitled to a hearing within 72 hours, but it is not going to be today in all likelihood and not going on right now. that's as much as we know, that's reportable at this time, jose.
