seeing right now, chris, is just the very beginning of this hearing. the judge is gotion over the instructions to the jury for this phase, telling them these are impact statements you ll hear first. this is from the family. we ll hear from travis alexander s sister and brother first off and the judge is just telling the jury how they should take in this information. we expect the first of these witness statements to start in it just a few minutes. and then it will be jodi arias turn to try to literally save her life. it will be her chance through a couple of witnesses. then we expect her to take the stand as well and give a last-ditch effort to try to save her had life to this jury. but you bring up the point that she told this television station right after the verdict she didn t want to save her life, that she wants the death penalty. it will be interesting to see what jodi arias says. this jury only took an hour 30 minutes to find there was cruelty in this murder, but i think, chri
tomorrow, deals only with one aggravating factor as it s called. is this murder unusually cruel. and the first witness will be the medical examiner who will talk about the 27 stab wounds. the slit throat. the gun shot to the head. that s the first part. if the jury finds unanimously, as frankly, i think most people expect they will, that it s unusually cruel, then they will go to a more traditional penalty phase, where both sides will get to make the case about whether jodi arias should live or die. and there, i think, it s much less predictable. the important thing to remember is that jodi arias only needs one juror to say no death penalty, and that s it. they don t have to be unanimous for it not to be the death penalty. they do have to be unanimous for a sentence of execution. jeffrey toobin, a fascinating development and a fascinating trial.

basically they call aid court clerk to read into the record some of his past convictions for burglary in the third degree. that proves the aggravator. what they have going for them is that every piece of evidence from the guilt phase, every horrible photograph that these jury ors have looked at. every mental picture they ve had of these girls tied to their beds or mrs. petit strangled and set on fire, that carries over into this phase as well and they can consider all of that evidence when they re deciding whether steven hayes should live or die. we re look at video of inside the bank, mrs. petit taking out $15,000, with steven hayes waiting outside in the car for her driving her back to the house. and then things went bad very, very quickly. there hadn t been much violence up to this point. after these video images were taken events escalated very rapidly. and this is the same jury that heard that evidence. when they returned back to the home, allegedly joshua told steven hayes, i
