Biden sued over coronavirus visa restrictions initiated under Trump

ADVERTISEMENT The case was brought on behalf of nearly 200 different plaintiffs, including those seeking to come to the U.S. to work or join family members, by a number of immigration lawyers and the American Immigration Lawyers Association. The State Department, which is named in the case, declined to comment on the case while the White House did not respond to request for comment. Counties have been added to the list through a series of six different presidential proclamations, five of them signed under Trump.  “Given the importance of protecting persons within the United States from the threat of this harmful communicable disease, I have determined that it is in the interests of the United States to take action to restrict and suspend the entry into the United States,” Trump wrote in his first order in late January of last year restricting the entry of Chinese citizens.

Biden administration announces end to Trump-era rule that rejected certain immigration applications with blank spaces The Biden administration announced Thursday it will not automatically reject certain applications for asylum or immigration benefits when a blank space is left on the forms, a reversal from a Trump-era policy that critics said was a blatant attempt to further crack down on legal immigration. During the Trump administration, US Citizenship and Immigration Services rejected applications for certain immigration benefits, including asylum and relief for victims of certain crimes, based on parts of the form being left blank, meaning the application would be sent back to the applicant.

Immigration: Biden administration announces end to Trump-era rule where USCIS rejected certain immigration applications with blank spaces

During the Trump administration, US Citizenship and Immigration Services rejected applications for certain immigration benefits, including asylum and relief for victims of certain crimes, based on parts of the form being left blank, meaning the application would be sent back to the applicant. The Trump-era rule increased the likelihood of rejections amid other policies that choked off legal immigration, like suspending much of family-based immigration amid the pandemic and gutting asylum.

Donald Trump has left Supreme Court immigration cases went with him

The Supreme Court on Tuesday dismissed challenges to Trump s public charge rule, a 2019 regulation denying green cards to immigrants if officials determine applicants may benefit from safety net programs, such as Section 8 rental assistance or food stamps. Biden rolled back some parts of the policy last month and directed federal agencies to study the impact of the broader Trump regulation by early April.  It marked at least the fourth time the justices have hit the brakes on major immigration litigation since Biden took office. In early February, the court canceled scheduled arguments about funding for Trump s border wall as well as his administration s remain in Mexico policy, which bars migrants seeking asylum from crossing the border.
