Feds Join Grubhub Suit To Back TCPA After High Court Order
Law360 (April 30, 2021, 6:00 PM EDT) The federal government has asked an Illinois federal judge to ignore Grubhub s contention that the U.S. Supreme Court made the Telephone Consumer Protection Act unconstitutional in a July 2020 order, saying robocall restrictions have been valid ever since the act was passed in 1991.
Grubhub Inc. can t escape liability for allegedly making autodialed calls during a regulatory donut hole period between 2015, when Congress added a TCPA exception for calls made to collect on government-backed debts, and last year, when the Supreme Court decided in Barr v. American Association of Political Consultants that the government-debt exception was content-based and severed the.

Kelley Drye’s Communications Practice Group presents this tracker of active Telephone Consumer Protection Act (“TCPA”) petitions before the Federal Communications Commission (“FCC”). With the recent increase in litigation regarding alleged violations of the TCPA, many issues relating to the interpretation of the statute have been presented to the FCC by impacted parties. These petitions can be primary jurisdiction referrals or be presented directly by a litigant in a TCPA action. The FCC currently has a number of petitions pending related to TCPA interpretation. The tracker below briefly summarizes each petition and the issues presented in them.
April 21, 2021 By Joe Rothstein President Biden is under heavy fire from progressive Democrats for ducking the question of whether to add four justices to the Supreme Court. But Biden appears to be on firm ground with the public on that issue. A recent Reuters/Ipsos poll shows that only 38% would favor adding justices. House Speaker Nancy Pelosi also tossed a bucket of cold water on the embers of that idea. Increasing the number of justices, though, isn’t the only way to combat the Republicans’ court packing efforts. According to that poll, while the public is leery of expanding the Supreme Court, two-thirds of the respondents would favor ending lifetime tenure. Another way to unpack the court would be to rotate justices off the high court after a fixed number of years and have them serve on lower courts. Presumably, Biden’s commission will hear public testimony on all these suggestions and more.
