Petition against IT Rules 2021: Grounds for content removal too broad, unconstitutional

In yet another challenge to the Indian government’s IT Rules 2021, one advocate Sanjay Kumar Singh has petitioned the Delhi High Court, arguing that the Rules are unconstitutional and should be struck down. He said that multiple provisions of the Rules do not meet the constitutional requirements of placing restrictions on free speech and expression, deserve to be struck down.
The court on Wednesday issued notice to the respondents: Union of India, MEITY, Ministry of Information & Broadcasting, and Ministry of Law & Justice.

A top official of the Ministry of Electronics and Information Technology on Monday downplayed the Supreme Court’s objections to the Intermediary Rules for lacking “teeth”, saying that there was “no conflict” between the Rules and the court’s priorities. “The way digital content is increasing and the way digital content is having an impact in everybody’s lives, the law will have to catch up with the time to enforce what’s good for the society. And ultimately, that’s what the Supreme Court has said, what the guidelines have said. But I don’t see any conflict between what the guidelines are and what the honourable Supreme Court judges have said,” Abhishek Singh, President and Chief Executive Officer of MEITY’s National e-Governance Division (NeGD) said in a discussion on Sansad TV.

IT Rules 2021: Abdicating legislative duties and delegating powers to the bureaucracy

A recent disturbing trend has emerged wherein the Government is not debating and discussing matters of national importance in Parliament. The government is seen using a back door entry to delegate away its legislative functions to the executive, often landing in the hands of the bureaucracy in the form of rules or guidelines that go virtually unchallenged and unopposed.
Last week, the Ministry of Electronics and Information Technology (MEITY) notified the Information Technology Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, which require intermediaries to conduct due diligence on specific parameters and set up a grievance redressal mechanism. Under these rules, publishers will also be required to follow a code of ethics.
