iAfrica 20 mins ago 4 min read Share with your network! On 13 December 2019, the Constitution Eighteenth Amendment Bill (the Amendment Bill) was published in the Government Gazette. Since then, a lot of water has passed under the bridge with regards to an amendment to the laws of the Republic of South Africa dealing with the expropriation of land without compensation. Subsequent to the publishing of the Amendment Bill amending section 25 of the Constitution, and as expected, the Expropriation Bill 23 of 2020 (the Expropriation Bill) was advertised in the Government Gazette. The Expropriation Bill is aimed at providing the mechanisms for and the circumstances under which land may be expropriated with and without compensation as envisaged by section 25 of the Constitution.

Expropriation is not needed to achieve land reform, there are better alternatives

Apartheid spatial planning was a travesty that saw unelected and prejudiced bureaucrats control the use and allocation of residential and agricultural land. The current government’s decision to pursue a similar faulty line of thinking by enacting into law the Expropriation Bill and the Constitution Eighteenth Amendment Bill is disastrous. Changing section 25 of the Constitution will place the control of all property, immovable and movable, in the hands of the state, thereby striking a blow to security of property rights and investor confidence – two things for which South Africans fought hard and long. The South African economy is floundering and desperately needs foreign investment. The threat of expropriation without compensation will be the final nail in the coffin of the dying economy and will lead to another credit rating downgrade.
