New law requires DUI suspects to submit to saliva tests as drug-impaired cases rise

A new law set to go into effect in August will require DUI suspects to submit to saliva tests designed to detect drug-impaired driving. The bill, S. B. 258, which was signed into law in May, gives saliva testing implied consent standing under Alabama law. Drivers suspected of DUI who refuse the test would face an automatic suspension of their license. The law currently holds this standing for drivers who refuse to submit to a breathalyzer test.

5 Jun 2021 According to reports, Rep. Eric Swalwell (D-CA) hired a private investigator to track down his colleague Rep. Mo Brooks (R-AL) to serve him a lawsuit for what Swalwell claimed responsibility for the Capitol riot on January 6. Swalwell has been unable to employ the aid of federal marshals to serve the suit because D.C. District Court Judge Amit Mehta cited separation of power concerns. Brooks, a Republican candidate in Alabama’s 2022 U.S. Senate race, insisted during an interview with Mobile, AL radio FM Talk 106.5 he was not avoiding Swalwell. He also pointed that as a candidate for U.S. Senate, he has made dozens of public appearances throughout his home state of Alabama.

New Alabama law increases use of saliva tests to catch drug-impaired drivers

Alabama Gov. Kay Ivey has signed into law a bill that law enforcement authorities say will help keep drug-impaired drivers off the road. The new law gives oral fluid (saliva) tests for drugs the same “implied consent” legal standing as the breath and blood tests used to detect alcohol after an arrest. Drivers arrested for DUI will be required to submit to the saliva test or lose their driving .
