Q: I ordered a sofa and a chair from a local furniture company. They were supposed to be delivered by March 2021. However, to date, nearly four months later, I am still waiting for them to be delivered.
In fact, the trader has informed me that the company is still trying to ship the items from abroad, and once this is arranged, I will need to wait another 40 days for the furniture to arrive in Malta.
I do not want to wait anymore. But when I informed the company that I want to cancel the order, they refused to do so. They also refused to refund me the deposit I had paid.
A sales contract is entered into when a consumer buys or hires a product or service for their own personal use from a person acting for the purpose of their trade, business, craft or profession. A sales agreement is binding whether concluded verbally, in writing and even electronically.

In view of this, it is in consumers’ best interest to take the necessary time to read and understand the sales contract before signing it.

The reason why a consumer wants to return a product they purchased is very important and may affect the type of remedy they are entitled to. When traders sell goods, consumer legislation provides that the goods sold must conform with the description and specifications as stipulated in the sales contract. This means that consumers must be supplied with goods that comply with the description given by the trader and possess the characteristics, features and qualities that the trader promised during the sale or had shown through a sample.
