PITTSBURGH – For the third time, counsel for Dollar General and Aldi argue that allegations brought against them and other retailers which said they unlawfully charged sales taxes on the purchases of face masks during the COVID-19 pandemic are unsupported, and should be dismissed.
Joshua James of Freeport (and on behalf of all others similarly situated) first filed suit in the Allegheny County Court of Common Pleas on Nov. 12.
(The case was later removed to the U.S. District Court for the Western District of Pennsylvania on Feb. 11.)
The lawsuit took aim at many different retailers, including Marshall’s, Forever 21, Sally Beauty Supply, Dry Goods, Amazon, Zazzle, Etsy, Brave New Look, Outdoor Research, Aldi, Dollar General and eBay.

PITTSBURGH – Due to the alleged expiration of a whistleblower claim’s statute of limitations, the Borough of Mount Pleasant is seeking summary judgment to dismiss a lawsuit alleging it wrongfully terminated its former police chief, for his pursuit to atone for alleged waste and wrongdoing committed by the municipal government.
Douglas Sam of Mount Pleasant first filed suit in the Allegheny County Court of Common Pleas on Oct. 16 versus The Borough of Mount Pleasant.
Sam became Mount Pleasant Police Chief on March 2, 2015, after being commended for his strong military background, leadership skills, experience and numerous certifications.
Pottery Barn
PITTSBURGH – The parent company of Pottery Barn introduced additional arguments in state court to support its allegations that an adjoining hamburger restaurant leaked both water and sewage into one of its mall stores in Mount Lebanon.
Williams-Sonoma Stores, Inc. of San Francisco, Calif. first filed suit in the Allegheny County Court of Common Pleas on Aug. 3 versus BRGR Management, LLC of Lansdale and SRG Cranberry, LLC, of Pittsburgh.
The plaintiff said its brand Pottery Barn leased and operated a retail store in the Galleria mall, located in Mount Lebanon. Adjoining the Pottery Barn store was BRGR, a gourmet hamburger restaurant, also located in the Galleria.
PITTSBURGH - A Pittsburgh restaurant faces a personal injury claim after one of its wait staff allegedly fell on a patron, according to a complaint filed in the Allegheny County Court of Common Pleas on May 4.
The complaint was filed by plaintiff Sharon Baskin, who visited the Wheelhouse Bar and Grill located at 777 Casino Dr. in Pittsburgh on October 10, 2020. Baskin says she was sitting in a chair at her table in the restaurant when a server suddenly fell on her, causing severe injury, including a cervical disc herniation.
Wheelhouse is owned by defendant Holdings Acquisition Co., LP.
The defendant is charged with negligence totaling at least $35,000 in claims.
PITTSBURGH – A Pittsburgh man claims that he received a severe shoulder infection as a result of an improperly administered influenza vaccine given at a Giant Eagle supermarket.
