Murder indictment accuses two Kingston men of depraved indifference in killing of 12-year-old girl

KINGSTON, N.Y. – Two city men have been indicted on a charge of murder in connection with the fatal shooting of a 12-year-old girl, according to the Ulster County District Attorney’s Office. Gilbert Thomas, 24, 9 Franklin and Robert “Nikki” James, 46, both of 49 Franklin St. were indicted by an Ulster County Grand Jury, according to the DA’s office. The indictment was handed up Wednesday, Dec. 30, the office said. Thomas and James are accused of second-degree murder for “acting in concert under circumstances evincing a depraved indifference to human life while recklessly engaging in conduct which created a grave risk of death to another person and causing the death of that person or a third person,” a press release issued Wednesday says.
