Nigeria’s Attorney-General of the Federation (AGF) and Minister of Justice, Abubakar Malami has told a Federal High Court in Abuja that former Vice President Atiku Abubakar is not eligible under the constitution to contest for President.
Malami said this in an affidavit in support of a suit marked FHC/ABJ/CS/177/2019 and filed before the court by the Incorporated Trustees of Egalitarian Mission for Africa (EMA).
EMA is challenging Atiku’s eligibility to contest for President and praying the court to hold among others, that considering the provisions of sections 25(1) &(2) and 131(a) of the constitution and the circumstances surrounding his birth, the former Vice President cannot contest for the top office.
The Attorney General of the Federation (AGF) and Minister of Justice, Abubakar Malami (SAN), has submitted that ex Vice President and serial presidential aspirant, Atiku Abubakar, is not eligible to contest for the office of the President of the Federal Republic of Nigeria because he isn t Nigerian by birth.
Atiku was born in Jada, Adamawa State. Jada wasn t part of Nigeria until 1961.
74-year-old Atiku was born in 1946, way before Jada was incorporated into Nigeria from Cameroon.
Malami submits that this means Atiku isn t Nigerian by birth a prerequisite for seeking the office of the President of Nigeria according to the constitution.
The AGF argues that, having not been born a Nigerian or by Nigerian parents, and having not met the provisions of Sections 25(1) &(2) and 131(a) of the constitution, Atiku would be violating Section 118(1)(k) of the Electoral Act should he put himself forward as a presidential candidate in future elections.

In his bid to justify his input in the matter, Mr Malami insisted in a statement signed by his spokesperson, Umar Gwandu, that his endorsement of the legitimacy of the indebtedness followed a “due diligence” carried out by his office.
But rather than clearing the thick clouds of doubts hanging over the debts, the statement which left gaps and many important issues unaddressed, has raised many more questions he should answer in the public interest.
