Health and Disability Commissioner Morag McDowell today released a report finding a doctor in breach of the Code of Health and Disability Services Consumers’ Rights (the Code) for failures in the care of a woman with dementia.
The woman and her partner went to see the doctor to complete a medical certificate certifying the woman’s mental capacity to appoint her partner as her enduring power of attorney (EPOA). A person can only make an EPOA if they have sufficient mental capacity to understand what an EPOA is and what its effect will be.

Deputy Health and Disability Commissioner Rose Wall today released a report finding an obstetrician/gynaecologist in breach of the Code of Health and Disability Services Consumers’ Rights (the Code) for failures in her care of a woman undergoing a routine procedure.
The woman visited the doctor regarding treatment for heavy menstrual bleeding and contraceptive options. The doctor recommended thermal ablation (removal of a thin layer of tissue in the uterus) to control the heavy bleeding and an intrauterine contraceptive device (IUCD).

The man was agitated and complained of pain in his upper thigh while at the Rowena Jackson Retirement Village. While a caregiver reported the man’s pain to the registered nurse, the nurse failed to commence a pain assessment tool or pain observation chart.
