ISRA Files Injunction Over FOID Card Backlog

By Benjamin Cox on December 26, 2020 at 7:53pm The Illinois State Rifle Association has filed a federal injunction about the State’s backlog of FOID Card applications. The injunction was filed in the U.S. District Court of the Northern District of Illinois’ Eastern Division. The hearing about the injunction was scheduled for Tuesday, but has been continued to January 15 th. Executive Director of the Illinois State Rifle Association Richard Pearson announced his displeasure with the delay for the hearing in a press release on Monday, calling the delays by both the court and the Illinois State Police disappointing and unacceptable. Pearson noted the FOID Card law in the press release, saying that ISP has failed to comply with the 30-day requirement to issue FOID cards or even a 60-day compromise that was worked out during the pandemic.

  ISP has said they’re working through the backlog, but there’s been an explosion of applications during the pandemic, but the delays and backlogs were around before the pandemic. The agency recently reported an average wait of 121 days and a backlog of 145,000 FOID cards.   Illinois State Rifle Association Executive Director Richard Pearson said the latest filing in the case initiated this summer will be heard Tuesday “requesting a judge order the state police to issue the FOID cards within the 30-day time limit as required by law.”     “They can’t purchase a firearm, they can’t purchase ammunition,” Pearson said. “We’ve had calls they go in there with a letter, they say it’s not valid so they can’t buy anything.”
