The plaintiffs asserted that without the requested relief, and in view of newly uncovered information, Clearview could move biometric data offshore, making it more difficult for the plaintiffs to ascertain privacy safeguards and enforce their rights.
The Monday filing includes a statement of supplemental facts that recounts the deposition testimony of Clearview’s general counsel, Thomas Mulcaire. The brief then incorporates deposition excerpts, some of which are redacted, into arguments in favor of the preliminary injunction.

On Wednesday, Macyâs Retail Holdings Inc. filed a searing motion to dismiss the plaintiff Isela Carmeanâs claims alleging violations of the Illinois Biometric Information Privacy Act (BIPA). The filing asserts that the plaintiff engaged in âlegal gamesmanshipâ for the purpose of forum shopping in her efforts to include Macyâs in the multidistrict litigation (MDL) against Clearview AI. The MDL participants are currently sparring over a preliminary injunction.
The motion explained that by Dec. 15, 2020, the Judicial Panel on Multidistrict Litigation consolidated every underlying case between individual plaintiffs and Clearview AI into the current Northern District of Illinois MDL, except for Carmeanâs case against Macyâs.
