Illinois Central Bus facing class action over employee fingerprint scans

BELLEVILLE A class action lawsuit filed against Illinois Central Bus alleges the defendant illegally collected and stored employee s fingerprint scans.  Rebecca Luecking and Tracey Meyer, on behalf of themselves and other persons similarly situated, filed a complaint Dec. 29 in the St. Clair County Circuit Court against Illinois Central School Bus LLC, alleging violation of the Illinois Biometric Information Privacy Act (BIPA).  The class action alleges that within the past five years, the plaintiffs worked for Central School Bus and were required to scan their fingerprints in order to clock in and out of work at job sites. The plaintiffs allege their fingerprints were recorded, collected and stored in violation of BIPA. They claim they did not give consent for their biometric data to be collected and stored. 

Face Surveillance and the Capitol Attack

After last week’s violent attack on the Capitol, law enforcement is working overtime to identify the perpetrators. This is critical to accountability for the attempted insurrection. Law enforcement has many, many tools at their disposal to do this, especially given the very public nature of most of the organizing. But we object to one method reportedly being used to determine who was involved: law enforcement using facial recognition technologies to compare photos of unidentified individuals from the Capitol attack to databases of photos of known individuals. There are just too many risks and problems in this approach, both technically and legally, to justify its use.

Advertisement Court Rejects Bid to Move BIPA Case to Binding Arbitration, Declining to Enforce Arbitration Clause in Terms of Service Tuesday, January 12, 2021 Sosa v. Onfido, Inc., 2021 U.S. Dist. LEXIS 658 (N.D. Ill.), a judge in the Northern District of Illinois refused to motion to compel arbitration for litigation brought under BIPA, finding that the arbitration agreement did not cover the defendant.  Read on below. The plaintiff in  Sosa had an account with Offerup, Inc., a marketplace where people buy and sell goods online.  According to the pleadings, OfferUp partnered with the defendant, Onfido, to establish users’ identities. Specially, the plaintiff alleged that users (including himself) upload their driver’s license or ID along with photos of their faces, and that Onfido’s software scans the images and extracts biometric identifiers in order to confirm if they match the uploaded IDs. BIPA class action alleges Subway collected, stored employee fingerprint scans

BELLEVILLE A Subway employee claims the restaurant chain violated the Illinois Biometric Information Privacy Act by collecting and storing employees fingerprint scans.  Robert Slone, on behalf of himself and all others similarly situated, filed a complaint Dec. 22 in the St. Clair County Circuit Court against Doctors Associates LLC, Franchise World Headquarters LLC and Subway Franchisee Advertising Fund Trust LTD, doing business as Subway, alleging violation of the Illinois Biometric Information Privacy Act.  According to the class action, Slone worked for Subway at its facility in Fairview Heights from June 2016 through September 2016. He claims he was required to use his fingerprint to clock in and out of work and that his fingerprint scan was stored in Subway s data base.
