Justice Faez Isa: fighting the fog

Opinion May 2, 2021 The short order of the Supreme Court of Pakistan – of April 26, 2021 – rendered by a majority of six with four honourable judges dissenting, in the review petitions filed by Justice Faez Isa, Mrs Sarina Isa, the Pakistan Bar Council, the Supreme Court Bar Association and the various high court bar associations across the country has been hailed as a triumph by the overwhelming majority of the serious-minded in the legal profession. It has been bemoaned by those close to the government as a victory of sentiment over substance (see Raoof Hasan’s article on these pages on April 30), and has been spun viciously on social media as the grant of immunity by a set of brother judges to one of their own. It is said that the constitutional authority of the Supreme Judicial Council headed by the honourable chief justice of Pakistan has been constrained. This is a sombre moment. One must begin with the prosaic facts.

Soli Sorabjee Soli and I graduated from the same law college, though in different years, the Government Law College, Bombay, as it was then known. Each of us was fortunate to find a berth in the same lawyers’ chambers that of the greatest, and also the most humble, of the giants of the Bombay bar: Sir Jamshedji Kanga. He was so well-reputed and revered that he was the only advocate on whose death, at the ripe old age of 94, the entire high court remained closed as a mark of respect. I was two years senior to Soli in the profession but, as we always joked, he was two years my ‘senior’ in matrimony he married Zena before I married Bapsi. Each of us had long since celebrated not only six glorious decades at the bar, both in Mumbai and in Delhi, but also celebrated our 60th wedding anniversary as well.

Supreme Court holds full court reference on retirement of Justice Malik National May 1, 2021 ISLAMABAD: A Full Court Reference was held here on Friday in the Supreme Court on the eve of retirement of Justice Manzoor Ahmed Malik, Judge of the Supreme Court. The reference was attended by all the judges of the Supreme Court, Attorney General for Pakistan, President Supreme Court Bar Association and large number of lawyers. Addressing the Full Court Reference, Chief Justice of Pakistan Justice Gulzar Ahmed while paying rich tributes said that tireless contributions of Justice Manzoor Ahmed Malik to the cause of justice and especially to the criminal jurisprudence has forged the path for generations of legal practitioners to come to be inspired by and motivated.

COVID-19: Supreme Court advances summer vacation to May 10 due to spurt in infections

Source: PTI New Delhi: Taking note of a surge in COVID-19 cases, Chief Justice of India (CJI) N V Ramana advanced Supreme Court s summer vacation on Saturday to May 10, instead of May 14, after the full bench of the court concurred with the proposal. On April 26, the CJI had taken note of the representations made by bar bodies such as the SCBA and the SCAORA seeking advancement of the summer vacation in view of the sudden surge in COVID-19 cases and decided to put them before the full bench for consideration. It is hereby circulated for information.Upon consideration of the suggestions from the bar due to the surge in COVID-19 infections, the Chief Justice of India has been pleased to direct that the summer vacation of the Supreme Court calendar 2021 be rescheduled to commence on Monday, May 10. Court shall reopen after the summer vacation on June 27, a circular issued by the apex court said.
