Salt Lake County prosecutor says police shooting is unjustified but won t file criminal charges

| Updated: 10:40 p.m. Salt Lake County District Attorney Sim Gill took the rare step Friday of declaring that a police officer was not justified in shooting a suspect. And he said this could happen more often going forward if officers shoot someone and don’t give a reason why they felt threatened. The lack of evidence is a key issue in Bryan Pena-Valencia’s death last March. According to a news release from Gill s office, Officer Omar Flores fired shots that killed Bryan Ulysses Pena-Valencia following a police pursuit in Taylorsville. Flores was wearing a body-worn camera that morning, but the camera did not record the shooting, a letter from Gill s office says. Investigators determined the camera became detached from Flores uniform as he chased Pena-Valencia over a backyard fence.
