USITC attorney backs BAT in Philip Morris patent dispute

An attorney for the US International Trade Commission (ITC) has recommended that the Commission find Philip Morris International (PMI) to have infringed British American Tobacco’s (BAT) patents, which would likely lead to PMI’s IQOS products being excluded from the US market as early as November 2021.
Administrative Law Judge Clark Cheney is hearing the dispute at the ITC, which began on Monday, January 25.
The trial, which is the latest development in the ongoing IP spat between US multinational tobacco company PMI and British tobacco manufacturer BAT, is expected to conclude next week, as reported by

WASHINGTON, Jan. 27, 2021 /PRNewswire/ Globe Specialty Metals, Inc., a subsidiary of Ferroglobe PLC (NASDAQ:GSM) ( GSM ), and Mississippi Silicon LLC ( MS ), together representing the majority of American silicon metal production, today welcomed news that the U.S. Department of Commerce ( Commerce ) will impose preliminary duties of 7.41% on all silicon metal imports from Malaysia.
Last August, the U.S. International Trade Commission (ITC) preliminarily determined that imports from Malaysia, along with Bosnia and Herzegovina, Iceland, and Kazakhstan, are a cause of material injury to the U.S. industry. On November 30, 2020, Commerce subsequently announced duties of 120% on all silicon metal imports from Kazakhstan, and on December 8, 2020, announced duties up to 47.54% on imports from Bosnia and Herzegovina and Iceland. The Commerce and ITC investigations are now in their final phases.

The escalating legal tussle between Samsung Electronics and Ericsson over patent infringements regarding network equipment technology is expected to be a long-running battle, as the Swedish telecom giant feels threatened by the Korean tech firm s fast-growing technological capability in the 5G market, according to a noted patent expert. Ericsson and Samsung were embroiled in a patent licensing dispute from late 2012 to early 2014. The agreement they struck then has now expired. This reminds me of the situation between Apple and Nokia, which also seem to have a need to go to court every time their agreement is up for renewal, Florian Mueller, who s best known for running the software patent blog FOSS Patents, told The Korea Times during a recent email interview.
