Ericsson and Samsung reach patent license deal, ending litigation

(Getty Images) Ericsson and Samsung have reached a multi-year global patent license agreement for cellular technologies including 5G, marking an end to related legal disputes between the two. The settlement is a positive for Ericsson, which took a hit to Intellectual Property Rights (IPR) licensing revenue in the first quarter thanks in part to then-unresolved contract renegotiations with Samsung. As a result of the IPR deal with Samsung, Cowen analysts anticipate faster resolution of Ericsson’s other outstanding expired patent license agreements given the South Korean vendor’s “lead steer status.”

The Swedish company, a leading owner of patents essential to telecommunications standards, sued the South Korean electronics manufacturer in December, claiming Samsung had failed to seek a licence to its IP in good faith. Ericsson subsequently filed further lawsuits at US district courts and at the US International Trade Commission. The dispute concerns standard-essential patents (SEPs) owned by Ericsson, covering key technology practiced in telecommunication networks. Standard-setting organisations’ rules governing SEP licensing stipulate that the patent owner must make standard-essential IP available on fair, reasonable, and non-discriminatory (FRAND) terms, while implementers such as Samsung must act in good faith as a willing licensee.
