NEW ORLEANS – A federal judge has swatted down a second environmental lawsuit alleging that a chemical company’s operations have caused medical problems and health risks for the plant’s neighbors in St. John the Baptist Parish.
Judge Martin Feldman of the Eastern District of Louisiana granted the motions of defendants DuPont and Denka Performance Elastomer of LaPlant to dismiss a case filed by plaintiff David Acosta and others, concluding that the plaintiffs lacked a sustainable claim for relief. NEW ORLEANS - A New Orleans man sued the Cornerstone Chemical Company and a Cornerstone supervisor, alleging unlawful discrimination and retaliation based on race, according to documents filed on March 2 in New Orleans federal court.
Plaintiff Okula Muhammad, an African American, was a reactor operator at the Cornerstone chemical plant in Westwego starting in 2014.
Muhammad s lawsuit says he was fired by his supervisor, defendant Greg Ritter, in December 2018 despite a positive work record, based on an incident that the plaintiff said was fabricated due to racial bias. Muhammad appealed the termination through his union and his employment was reinstated almost a year later.
NEW ORLEANS - A St. Tammany Parish man sued Home Depot and its insurance company in the St. Tammany Parish District Court last year after a gas auger malfunctioned and sliced his ankle, and the companies on March 4 moved the case to New Orleans federal court.
Plaintiff Miguel Martin rented a gas auger from the Home Depot on Service Road in Slidell for drilling fence post holes in July 2019. Martin says he powered on the auger and began to operate it, at which point the gas throttle power cycled.
The auger s blade then spun erratically despite Martin not touching the throttle; as a result, the blade sliced into the plaintiff s left ankle, causing a deep gash that required medical attention, the suit says.
