OAKLAND, Calif. (Legal Newsline) – A class action lawsuit alleges Tootsie Rolls are not only unhealthy because of their sugar content but for the amount of artificial trans fats in them.
Filed Jan. 25 by San Diego lawyer Gregory Weston in Alameda County Superior Court, the case details the health problems associated with artificial trans fats, noting they were banned in restaurants in New York City in 2006.
It says the use of partially hydrogenated oils in Tootsie products “was unfair.”
“Although commercially viable alternative formulations and substitutes for PHO were available, Defendant elected not to use them in Tootsie products in order to increase its profits at the expense of consumers’ health,” the lawsuit says.

SAN FRANCISCO (Legal Newsline) – A class action plaintiff can’t sue over 26 different types of ChapStick when she only purchased three of them, the products’ maker is arguing.
GlaxoSmithKline filed a motion to dismiss Feb. 26 in San Francisco federal court in its defense against a lawsuit that claims its products aren’t “100% Natural,” as they claim to be.
GSK says Lisa Moore lacks standing to pursue her claims and has also failed to allege enough specific details to justify her fraud allegation. And her claims that the products contain synthetic ingredients are unsupported, the company says.
“She seeks injunctive relief correcting these statements though she no longer claims to be deceived by them and she only intends to purchase them again if they are reformulated to contain only natural ingredients,” says the motion, which was authored by lawyers at Dechert LLP.

SAN FRANCISCO (Legal Newsline) - Plaintiff lawyers leading multidistrict litigation against Bayer AG over its Roundup herbicide are scheduled to face off against dissident lawyers in federal court in California tomorrow as a judge hears arguments for and against an 8.5% “common benefit” fee that opponents call an $800 million “money grab.”
The fees would come off the top of the nearly $11 billion Bayer has offered to settle thousands of lawsuits claiming Roundup causes non-Hodgkin’s lymphoma, a common cancer of the lymphatic system. Both Bayer and regulators in the U.S. and most other countries consider Roundup and its main ingredient, glyphosate, to be safe, but plaintiff lawyers in the U.S. have won several large court victories based on testimony of their own experts who maintain glyphosate causes cancer.
