When informal means illegal: Italian interior ministry guilty of pushbacks to Slovenia

A court in Rome has ruled that “informal readmissions” from Italy to Slovenia are unlawful, in a case concerning a Pakistani asylum seeker who was subjected to a series of violent pushbacks stretching from Italy to Bosnia-Herzegovina.

A ruling by Rome tribunal (personal rights and immigration section) on 18 January 2021 declared the practice of informal readmissions from Italy to Slovenia that have intensified since the spring of 2020 to be unlawful,

The ruling concerned a case brought by lawyers Caterina Bove and Anna Brambilla on behalf of a Pakistani asylum seeker who was sent back from Italy after reaching Trieste, and who ended up living in destitution in Sarajevo in a case involving serial pushbacks.

The Court of Rome ruled that the readmission procedure enacted at the eastern Italian border based on an accord between Italy and Slovenia in 1996 is illegitimate. Judges upheld an appeal brought by a Pakistani asylum seeker who arrived in Trieste and was readmitted in July to Slovenia, then to Croatia and then to Bosnia.
Readmissions of migrants from Italy to Slovenia are illegitimate, ruled the Court of Rome in an ordinance on January 18 when it upheld an urgent appeal brought by a Pakistani asylum seeker.
The man had arrived in Trieste and was readmitted in July 2020 to Slovenia, from there to Croatia, and further on to Bosnia. Judges said the man has the right to immediately enter Italy to apply for asylum.

(CN) Italy is illegally sending asylum seekers who cross its borders back into the Balkans, where they are routinely beaten and mistreated by police, according to an Italian judge.
In a ruling this week, Judge Silvia Albano with the Court of Rome found that Italian authorities illegally expelled a 27-year-old gay Pakistani man last July without processing his claim for asylum after he was picked up by police in Trieste, a city near the border with Slovenia. He said he was fleeing persecution for his sexual orientation in Pakistan.
