Seizures were made as part of agencies’ Strategic Trade Control Enforcement (STCE) mandate
The Directorate of Revenue Intelligence (DRI), the Customs and domain experts recently carried out two crucial seizures of items possibly linked to missile, says the Smuggling In India Report 2019-20 of the DRI.
In the first case, an inter-agency coordination led to the interception of a consignment of chemical that could be used as missile propellant. The dual use chemical, wrongly declared as harmless, was transiting through India while being transported between two foreign countries.
As the chemical was notified in the Special Chemicals, Organisms, Materials, Equipment and Technology (SCOMET) list of the Directorate General of Foreign Trade, the consignment was seized under the relevant provisions of the Customs Act and the Weapons of Mass Destruction and their Delivery Systems (Prohibition of Unlawful Activities) Act.

The EU Dual-Use Regulation regulates exports outside the EU, transfers inside the EU, transit through the EU and the brokering of certain sensitive goods, services, software and technology (referred to as “items”) that are considered “dual-use.” Dual-use items have both military and civil applications. The EU has updated its export control rules for dual-use items to (1) take account of Brexit, (2) ensure consistency with recent developments in international non-proliferation regimes and export control arrangements, and (3) address cyber-surveillance and other security threats stemming from new technologies, reinforce cooperation among competent EU authorities, and impose enhanced compliance obligations (including a requirement to adopt internal compliance programs) on businesses. These updates, which are addressed in turn, will have significant implications for businesses dealing in dual-use items.

Biden has promised to reverse Trump’s decision to walk out of the 2015 Paris Accord on climate change on his first day at the White House. (Ilustration by C R Sasikumar)
As the US formally declares Joe Biden as the next president, one important legacy from Donald Trump is likely to endure. It is the proposition that “like-minded countries” must come together to cope with emerging global challenges, including the governance of emerging technologies that are reshaping relations within and among societies. India traditionally relied on multilateral approaches to govern advanced technologies or chose isolation when the rules did not suit it. The time is now ripe for Delhi to consider coalition-building as a major tool of its tech-diplomacy.
