Dish Network Sues Peloton, Lululemon And Icon Over Streaming Technology

Dish Network Corp. filed lawsuits against Peloton Interactive, Lululemon Athletica and Icon Health & Fitness over its workout streaming technology. The lawsuits, filed Tuesday in federal court in Texas and Delaware on behalf of Sling TV, accuses Peloton, NordicTrack-owner Icon Health & Fitness Inc. and Mirror-owner Lululemon using Dish’s patented technology that “allows Internet users to stream content from across the world in real-time at the highest possible quality,” according to Bloomberg. The suit claims the technology was created by Move Networks, which was acquired by Dish in 2010. The patents addressed include ways to improve online video quality including fast-forwarding, rewinding and browsing on multiple streams without interruption. Sling uses the technology in a bundled offering for live TV channels streamed over the internet for a monthly fee. Dish said Sling TV can “replicate the streaming-while-exercising experience.”

Icon Health & Fitness Sues Peloton For Patent Infringement Over Bike+

Icon Health & Fitness Inc. filed a complaint in the U.S. District Court for the District of Delaware against Peloton Interactive Inc. for allegedly infringing the patent-in-suit for its automatic control Bike + product. According to the complaint, Icon was the first to develop and commercialize interactive, connected technology that allowed in-home, live, and on-demand instructor-led classes with competition and leaderboards (i.e., iFIT) at least 12 years before Peloton was founded.  ICON asserted that it unveiled its first iteration of iFIT in the late 1990s at the Atlanta Super Show. Icon claims Peloton’s Bike+ “incorporates ICON’s patented automatic control and interactive, integrated weight system as a key new feature. Peloton calls the automatic control ‘Auto Follow,’” which automatically adjusts the bike’s resistance to match an instructor’s callout.

NordicTrack Co Can t Hit Brakes On Peloton Sales In IP Suit

ADVERTISEMENT ADVERTISEMENT NordicTrack Co. Can t Hit Brakes On Peloton Sales In IP Suit Law360 (February 22, 2021, 10:46 PM EST) A Delaware federal judge on Monday rejected Icon Health & Fitness bid for a preliminary injunction to block Peloton from selling its new Bike+ product, ruling that Peloton raised enough questions on the validity of its rival s patent-infringement claims to avoid a shutdown of its sales. U.S. District Judge Richard G. Andrews said that Icon Health & Fitness Inc., which makes NordicTrack exercise products, offered only conclusory assertions to invalidity while relying almost solely on an expert s declaration that failed to demonstrate a likelihood of success on its claims.
