Madrid: a flourishing system? 29-09-2016 Progress on implementing the Madrid System for international trademark registration around the world presents a mixed picture, as Sarah Morgan reports. The World Intellectual Property Organization’s (WIPO) Madrid System is certainly thriving:  in 2019, it recorded its 1.5 millionth international trademark registration, in the same year that the United Nations agency celebrated 30 years since the adoption of the Madrid Protocol, the cornerstone of the Madrid System. While the system has been in existence for more than 125 years, three-quarters of its current members joined it during the past three decades. Membership in the Madrid System quadrupled from just 25 members in 1988, to 107 members now. Secretary of State for Justice closes conference on intellectual property

Today, the Secretary of State for Justice, Anabela Pedroso, gave the closing address at the High Level Conference on the topic of The Intellectual Property Metamorphosis in the Age of Digital Transition , as part of the Portuguese Presidency of the Council of the European Union. Organised by the Ministry of Justice and by the National Institute of Industrial Property (INPI), over 33 speakers participated in the conference, debating the transformation of intellectual property in the age of globalisation. Underlining the links between intellectual and industrial property and the fundamental property rights enshrined in the Universal Declaration of Human Rights, the Secretary of State emphasised the role of this intangible asset in the revitalisation of the economy.

The European Union Intellectual Property Office (“ EUIPO”) and Organisation for Economic Co-Operation and Development (“ OECD”) recently published a Report 1 on counterfeit pharmaceuticals based on global customs seizure data from 2014 to 2016. Counterfeit pharmaceuticals are traded medicinal products that infringe trade marks and include fake antibiotics, lifestyle treatments and pain killers. The Report outlines the significant implications of this ever-growing illegal industry on governments, companies and citizens and provides policy makers with evidence of the threat that this illicit activity poses to the value of pharmaceutical companies’ intellectual property rights (“IPR”) and to the health of its citizens. The hope is that officials across the globe will use the empirical evidence within the Report to formulate a new and improved strategy to combat this hazardous trade.

The association of Cypriot producers who own the EU collective trademark Halloumi went to the ECJ to argue against a decision by the European Union Intellectual Property Office (EUIPO) which ruled in favor of the Bulgarian company M.J. Dairies EOOD, which makes a cheese-like product and non-dairy meat extracts.
