To embed, copy and paste the code into your website or blog: There has been a flurry of activity in the name, image, likeness (“NIL”) arena over the past several months.  We previously discussed the NCAA’s about-face decision to permit student-athlete compensation, as well as related ongoing state and federal efforts, here, and the NCAA NIL Working Group’s recommendations here.  Recently, the NCAA’s formal approval of its proposed rule permitting NIL compensation for certain endeavors by student-athletes was stymied by a January 8, 2021 letter from the Antitrust Division of the U.S. Department of Justice.  In the letter, then Assistant Attorney General Makan Delrahim cautioned that the NCAA’s planned approach to regulate NIL “may raise concerns under the antitrust laws.”

Parents ask US Supreme Court to make Maine support school choice

A group of parents in Maine seeking state tuition assistance to put their children in a religious private school have asked the United States Supreme Court to rule on their behalf. At issue is a state provision that only allows for tuition assistance if a private school is nonsectarian in accordance with the First Amendment of the United States Constitution. The First Liberty Institute, the Institute for Justice, and others filed the appeal on behalf of the families to the Supreme Court on Friday in the case of Carson v. Makin. “By singling out religion and only religion for exclusion from its tuition assistance program, Maine violates the U.S. Constitution,” said Institute for Justice Senior Attorney Michael Bindas in a statement.

The Center for American Liberty (@Liberty Ctr) in conjunction with the Dhillon Law Group, Inc. (@DhillonLaw), on behalf of churches in San Bernardino County and Riverside County represented in Gish v. Newsom, the Supreme Court of The United States ruled tonight that the denial of an injunction by both the District Court and the 9th Circuit was wrong. The Center for American Liberty filed Gish et al. v. Newsom et al., its first lawsuit challenging California’s COVID restrictions on faith organizations in April, 2020, challenging Governor Newsom’s COVID emergency orders that defined religious institutions hosting live services as non-essential. Using a now-disfavored legal standard as its basis, a federal district court in southern California refused to enjoin the government’s sweeping clampdown on religious liberty.

Glenn Hamer, president and CEO of the Arizona Chamber of Commerce and Industry, has seen the state s economic highs and lows. And after 14 years with the chamber, he s moving to Texas later this month to become president and CEO of the Texas Association of Business.
