A federal judge blocked an Arkansas law Tuesday that would ban nearly all abortions starting from conception in the state, calling it categorically unconstitutional.
U.S. District Judge Kristine Baker issued a preliminary injunction preventing enforcement of the law that was set to take effect on July 28 while she hears a challenge to its constitutionality. Baker called the law unconstitutional because it would ban nearly all abortions before a fetus is considered viable outside of the mother s womb. Since the record at this stage of the proceedings indicates that women seeking abortions in Arkansas face an imminent threat to their constitutional rights, the Court concludes that they will suffer irreparable harm without injunctive relief, she wrote.
