Calif. Justices Say USA Taekwondo Must Face Sex Abuse Suit
Law360 (April 1, 2021, 7:40 PM EDT) The California Supreme Court on Thursday adopted a two-step test to determine whether a governing organization can be sued for a person s injuries caused by a third party, finding claims against USA Taekwondo can proceed because it had a legal duty to prevent a coach from sexually assaulting three minor athletes.
In a unanimous ruling, the state s highest court affirmed a lower appellate court s decision that USAT can t escape a suit by three athletes who allege the organization and the U.S. Olympic Committee, now known as the U.S. Olympic and Paralympic Committee, had a duty to protect them from being sexually abused.
