The district on Wednesday filed a legal petition asking a court to find the State Board of Education didn t have the authority to settle a 2017 lawsuit with the Oklahoma Public Charter School Association in a way that will allow charter schools to receive more local tax dollars. The SBE (State Board of Education) is granted certain powers by the Legislature. Those powers do not include making changes to Oklahoma statutes or the Oklahoma Constitution, particularly to the public school funding mechanism, according to the lawsuit filed in Oklahoma County District Court.
The district seeks a declaratory judgment on state law regarding school funding and a decision on whether the State Board of Education has the authority to implement the proposed settlement to boost charter school funding through local tax sources.
