Colorado Privacy Act: US Consumer Data Privacy Framework Continues Expansion | White & Case LLP

The enactment of the Colorado Privacy Act continues the trend of state legislatures guiding the development of the general consumer data privacy framework in the U.S. The legislation is set to take effect on July 1, 2023. The Colorado Privacy Act extends consumer data protections and business compliance obligations in a manner similar to the California Consumer Privacy Act ( California Privacy Law (CCPA) ), the upcoming California Privacy Rights Act ( California Privacy Rights Act (CPRA) ), and legislation enacted in Virginia earlier this year, the Consumer Data Protection Act ( Virginia Privacy Law ). On July 7, Colorado Governor Jared Polis signed into law the Colorado Privacy Act (“CPA”), a sweeping law that creates substantial new obligations for organizations that process the personal data of Colorado residents. The CPA is scheduled to become effective on July 1, 2023. Between now and the effective date, organizations with business operations or customers in Colorado should carefully assess whether they fall within the CPA’s scope (whether they are located in Colorado or not), and work toward compliance if the law applies to them.
