MassCBA Statement on Withdrawal of Lawsuit Against Delivery Rules

After an outcry from advocates including the Massachusetts Cannabis Business Association (MassCBA), the Commonwealth Dispensary Association announced that it will withdraw its lawsuit seeking to void new Cannabis Control Commission delivery regulations. TILT Holdings Inc Statement on CDA Lawsuit

Earlier this month, the Commonwealth Dispensary Association (“ CDA”) filed a lawsuit against the Cannabis Control Commission related to new delivery regulations that would benefit social equity and economic empowerment operators. Commonwealth Alternative Care (“ CAC”), a wholly owned subsidiary of TILT”) and a member of the CDA, has been clear in expressing its concerns regarding the possibility of filing such a suit and is extremely disappointed in the CDA’s decision to pursue litigation. Plaintiffs drop suit over marijuana delivery rules

Stung by an exodus of members since it filed suit to block new cannabis industry rules permitting home delivery, the business group that represents most of the stateâs bricks-and-mortar marijuana shops announced Monday morning that it is dropping the legal challenge. The Commonwealth Dispensary Association and its attorneys from Foley Hoag argued in a lawsuit that the new delivery-only license types created by the Cannabis Control Commission violated the stateâs marijuana law, which they said gives the retailers the right to deliver cannabis under their existing licenses. âSimply, the CCC overstepped its authority and disregarded state law, radically upending the established rules that hundreds of small businesses and their host communities operated in accordance with since 2016,â the CDA said in a statement when it filed its suit this month.
