Evidence still pending in McHenry Street murder case

Assistant Commonwealth’s Attorney Jerad Smith had no objection to a pretrial hearing being set, saying that all evidence testing has been significantly slowed in recent times, so Judge Andrew Self set the next hearing for January 27, when he is hopeful this case will finally be able to move forward. The original arrest warrant from Hopkinsville police says Torian and Moore had been in an argument while both were passengers in a vehicle on McHenry Street in August of 2019. Torian was in the back seat when he exited, opened the front passenger door and allegedly shot Moore in the head.

Moore said he wasn’t necessarily asking for a full release from custody and was willing to work with all parties involved to get Martin treatment. Judge John Atkins asked Moore and Whaley to speak with Jailer Brad Boyd about protocols for securely transporting Martin to a doctor’s appointment and told Moore to also be in touch with the local VA medical offfice in Hopkinsville about their protocols for seeing an inmate. Martin is charged with three counts of murder, arson, attempted arson, first-degree burglary and three counts of tampering with physical evidence. Each count of the indictment alleges Martin acted “alone or in complicity with others or another.”
