On Tuesday, Apple Inc. opposed a trademark applied for by Shenzhen Guardian Bao Communication Co. Ltd. (Shenzhen Guardian). The Trademark Trial and Appeal Board (TTAB) filing takes issue with the proposed mark on the basis that it closely replicates Appleâs registered âiPhoneâ marks, including those used in connection with the iPhone X device Apple makes, markets, and sells. The similarity of the proposed âaifonxâ mark to its own Apple contends, as reprinted below, is likely cause consumer confusion and harm its brand.
According to the opposition, Appleâs mark has been famous since long prior to the filing date of Shenzhen Guardianâs application in July 2020. In addition, the opposerâs marks have been used in connection with the iPhone X since Nov. 3, 2017 when Apple brought the model to market.

May 16 may be closing night for the 2021 RiverRun International Film Festival, but screenings of some films are far from over.
âThis is the first time in our history weâre having a closing night film at the drive-in, but there are still going to be films left that people can watch after closing night,â Rob Davis, executive director of RiverRun, said.
As of Sunday, there are 14 films in RiverRunâs Virtual Theater and some of them are available through May 18.
Once a virtual ticket is purchased, viewers have 72 hours to watch the film. That means if a ticket is purchased on May 18 for one of the last four films running through May 18, people will still have 72 hours of viewing.
Background
The patent statute recognizes that an invention may be jointly invented, however, there is no definition of inventorship in the patent statute. For this reason, the courts have been left to determine what constitutes sufficient contribution to an invention to qualify one for inventorship. 35 U.S.C. § 116 (2018) states:
Inventors may apply for a patent jointly even though (1) they did not physically work together or at the same time, (2) each did not make the same type of amount or contribution, or (3) each did not make a contribution to the subject matter of every claim of the patent.
Thus, the statute sets out elements not required for joint inventorship but fails to “set forth the minimum quality or quantity of contribution required for joint inventorship.”
