Marijuana decriminalization takes effect in Montana; authorities react By: Jonathon Ambarian and last updated 2021-01-01 19:41:26-05 HELENA — As of the first moments of 2021, it’s no longer illegal to possess small amounts of marijuana for recreational use in Montana. However, there are still a number of open questions before any legal sales take place. In November, voters approved Initiative 190 and Constitutional Initative 118 by wide margins. Together the measures legalize recreational marijuana for people 21 and older. While the Montana Leglsiature is likely to reshape the state’s marijuana laws in response to the initiatives, the first provisions took effect at midnight Jan. 1 – before lawmakers even had a chance to meet.
