Updated: 5:09 PM EDT Jul 19, 2021 A judge denied the Cleveland Metroparks Zoo s motion for a temporary restraining order to prevent the Pittsburgh Zoo from continuing to use the phrase “Asian Lantern Festival Thursday.Judge James Gwin of the U.S. District Court for the Northern District of Ohio found that Cleveland Metroparks failed to meet any of the criteria necessary under a temporary restraining order. Gwin said the phrase, “Asian lantern festival,” would likely be considered a generic term that would not be entitled to protection under trademark law. Several other zoos throughout the U.S. also use the name of the ancient traditional festival dating to 206 B.C. to describe the cultural essence of their events. The Asian Lantern Festival is in its fourth year in Cleveland, drawing thousands of visitors and millions of dollars in revenue. It is running from July 14 to Sept. 5.
