(Reuters) - The U.S. Department of Justice dropped its lawsuit accusing Yale University of discriminating against Asian and white applicants in undergraduate admissions, as the debate over affirmative action in higher education heads for a possible showdown at the Supreme Court.

Wednesday’s voluntary dismissal of the lawsuit, which had been brought by the Trump administration, followed a Nov. 12 decision by a federal appeals court that Harvard University’s use of race in undergraduate admissions complied with federal civil rights law.

On January 13, 2021, the Democrat-led US House of Representatives voted to impeach outgoing Republican President Donald Trump for a second time. Trump had apparently whipped up a group of supporters who had invaded Congress on January 6, seeking to stop the confirmation of Joe Biden as the next president, then failed to immediately disown them. Five people were killed in the assault.
Trump had earlier been impeached on December 18, 2019, on two counts: abuse of power and obstruction of Congress. He was acquitted by the Republican-majority Senate on February 5, 2020.
