The Lilongwe Chief Resident Magistrate Court has on Wednesday, April 28 thrown away applications by lawyers representing Enlightened Christians Gathering (ECG) Church Leader Shepherd Bushiri and his wife Mary, to have their extradition case dismissed for lack of legal basis.
Another request to have the matter referred to the Chief Justice has equally been dismissed, saying the matter can be handled by the Magistrate’s court.
The development means that hearing of the extradition processes is now expected to commence.
One of the lawyers representing the couple, Wapona Kita, applied that the case needed to be dismissed as per South African governmentâs request, arguing that the request is based on SADC Protocol which is not domesticated in Malawi.
The Lilongwe Chief Resident Magistrate Court has set Thursday, April 22 to decide on the bail application for 2 senior government officials and a contractor on a case involving the plunder of Covid relief funds.
The 2 government officials have been identified as Director of Administration in the Office of the President and Cabinet Rashid Mtelera and Dominic Chimaliro from the same office. The 2 and a contractor Martin Mainja appeared before the court this morning.
They allegedly misappropriated over K97 Million. The trio has been charged with 4 counts of abuse of office, conspiracy to defraud the government, and flouting procurement procedures.

The Zomba Chief Resident Magistrate’s Court has convicted and sentenced a court marshall, Davie Saona 35, to 3 years imprisonment with hard labour for forging court documents in an attempt to release two convicts from prison.
The court heard from the state prosecutor, Assistant Superintendent Peter Pilingu that, Saona who was working as a court marshall at Zomba High Court, on November 18, 2019 forged court documents in an attempt to release two convicts, Lloyd Phiri and Imran Banda, who are serving their sentences at Zomba Maximum Prison for robbery charges.
According to the prosecutor, Saona forged a signature of Judge Zione Ntaba and others with an aim of releasing the two convicts on bail pending appeal.

The Lilongwe Chief Resident Magistrate’s Court has sentenced two men each to 12 years in prison for robbing a 26-year old woman K5000 cash before they raped her.
The two, Frank James Mdyomba and Rodgers Namadenga Satana, were convicted on their own plea on Tuesday.
The court, through State Prosecutor Bauleni Namasani, heard that the duo were among five thugs that attacked the victim on the night of 16 October last year between Sana Mega Shop and Lizulu Market in Area 4 within the city.
The victim was on her way from her workplace when the pair attacked and robbed her.
The Senior Chief Resident Magistrate Court sitting at Mkukula in Lumbadzi, Dowa has sentenced a 45-year-old man Chikumbutso Jamu a fine of six hundred thousand kwacha in default of 24 monthsâ imprisonment for the offences of being found in possession of machinery used to duplicate copies of artist work and being found in possession of infringed copies all contrary to section 113 of Copyright Act.
“The court through the state prosecutor, Bod Msukwa heard that on February 28th, 2021, COSOMA inspectors were tipped anonymously that the convict was in possession of machinery used for duplicating copies of artists work without a licence.
After conducting a raid at the suspects house, the Inspectors found 2000 Master CDs and 68 other CDs, 2 Duplicating Machines, 1 Canon Printer, 1 Prixma Printer, 1 Acer Laptop, 1 Sabara Laptop and 10 DVD Writers which Jamu used in carrying out the crime.
