The High Court has refused to hand a Kenyan woman custody of her son after the Children’s Court put him under the care of his father, a senior ex-Scotland Yard detective.
The woman identified as XY is embroiled in a legal battle with her 67-year-old ex-lover, BH, over custody of their son.
XY said the magistrate at Tononoka Children Court deprived her custody of his son for 40 days yet he is still breastfeeding.
She said she is fearful that harm may befall the child while in the custody of his father because BH had asked her to abort the pregnancy and her son had sustained injuries while with him before.

The DPP has been given five weeks to decide if Julius Wambua will be charged afresh.
A Kithimani court has given the Director of Public Prosecution (DPP) five weeks to decide if fresh charges will be pressed against former convict Julius Wambua, who was released last week by the High Court following a successful petition to overturn a wrongful conviction.
Senior Resident Magistrate Eva Wambugu on Monday directed that the mention for directions in the retrial of Wambua on alleged incest charges be conducted on January 25 next year.
The prosecution had sought for time to study Wambua’s case files as well as last week’s judgment delivered by Justice George Odunga in Machakos.

Dunmanway, 18 December 1920 - An Auxiliary cadet has been arrested for the murder of the popular Dunmanway parish priest, Canon Thomas Magner, 73, and Tadhg Crowley, a 24-year old farmer’s son. Both men were shot dead on the afternoon of 15 December.
According to an official report from Dublin Castle, Cadet Vernon Hart had been in charge of 30 Auxiliaries who left Dunmanway in two lorries and were en route to Cork where they planned to attend the funeral of one of their comrades who was recently killed in an ambush at Dillon’s Cross in Cork. Witness testimony suggests that Cadet Hart had been drinking heavily and that his judgement may have been impaired.
