Worcestershire mums reminded of rights to see children ahead of Mothers Day

REMINDER: Rupinder Nandra warned county mums ahead of mothers day MOTHERS across Worcestershire are being reminded that their children have the right to spend time with them if they so wish, particularly on special occasions. As Mother’s Day approaches on 14 March, family lawyer Rupinder Nandra is warning mums in advance that they need to make sure contact arrangements are in place so they do not miss out on quality time together. Ms Nandra, from Worcestershire law firm mfg Solicitors, is concerned that too many divorced parents think the law specifies an equal amount of time with the mother and father, but this is not the case.

Bursting Bubbles: The One Day of Christmas

Bursting Bubbles: The One Day of Christmas Date:21 DEC 2020 Earlier this month, Family Law published my article summarising Government Guidance on the formation of Christmas Bubbles for a five-day period between 23 and 27 December 2020. In light of the Prime Minister’s announcement on Saturday, 19 December, that Guidance has now changed with effect from 00:00 on Sunday, 20 December. What follows is a summary of the new Guidance, which is law, for England only (each of the four countries of the UK has its own regime, details of which are available on the appropriate Government websites). First, and importantly, minor children of separated parents may still move between their parents’ homes, even if one or both parents lives in a Tier 4 area (although as noted below neither household may then form a Christmas Bubble). And, buried in the exceptions to the general travel restrictions is clarification (from all four Governments) that this includes such children moving across

Family Law Week: Surrogacy and HFEA Update: December 2020 (Part 1)

A decision in which Keehan J reads down various limbs of HFEA 2008, s.54 in order to make a parental order. The three issues in the instant case were that the application was made outside of the six-month time limit (s.54(3)); whether at the time of the application the mother and father could be found to be two persons who were living as partners in an enduring family relationship (s.54(2)(c)), and whether the child s home at the time of the application and the making of the order could be said to be with both applicants (s.54(4)(a)). The case concerned a child (A) born in February 2017 as a result of a surrogacy arrangement in the UK. A s intended parents (M and F), who were also his biological parents, separated during the course of M s pregnancy.  Shortly after A s birth, M applied for A to be made a ward of court. The judge confirmed the wardship and noted that F had indicated he had no wish to be involved in the proceedings, nor to play any part in the upbringing of A.
