New lawsuit challenges fast-track permits used for oil and gas pipelines nationwide

New lawsuit challenges ‘fast-track’ permits used for oil and gas pipelines nationwide For nearly a decade, pipeline companies have relied on the contested Nationwide Permit 12 when their projects cross waterbodies in the U.S. Five environmental groups have filed a lawsuit in a Montana federal court alleging that the way that the U.S. Army Corps of Engineers issues permits for oil and gas pipelines nationwide violates some of the country’s cornerstone environmental laws. This new lawsuit, filed May 3, is the most recent round in a nearly decade-long battle, sparked under the Obama administration, over how regulators approach the environmental impacts from oil and gas pipelines and the extent to which the public gets a say in the permitting process.

Brookfield Renewable Temporarily Shuts Down 3 Kennebec River Dams To Protect Salmon Migration

Flickr Brookfield spokeswoman Miranda Kessel says the fourth dam, Weston, pictured above, will continue to operate, because studies show the Salmon stand a better chance of survival passing through the turbines than when they spill over the top of that dam. Brookfield Renewable has shut down three of its four hydroelectric dams on the Kennebec River, after federal regulators warned that the company was in danger of killing endangered Atlantic Salmon without authorization. Brookfield is at the center of a dispute with conservationists and government agencies over whether some or all of the dams should be removed, in order to help the salmon survive, or whether other actions such as installing fish ladders or elevators can do the job.

(See our 2021 Insights article “Under Biden, Energy Policy May Shift to Carbon Reduction.”) It has announced support for utilities that operate a portion of the bulk power grid taking steps to integrate the cost of carbon into their economic and operational decisions, so carbon-emitting generators run less frequently and low- or zero-carbon-emitting generators run more often. And FERC appears poised to take several actions designed to promote the addition of transmission lines to bring new renewable energy resources to the grid.
