SCOTUS Heard Arthrex v Smith & Nephew on PTAB Authority

Friday, April 9, 2021 The US Supreme Court hears relatively few patent-related cases in any given term.  However, on March 1 st, the court heard oral arguments in an important case challenging the very structure and authority of the U.S. Patent and Trademark Office’s administrative review board.  In  Arthrex Inc. v. Smith & Nephew Inc. the Court will decide whether the administrative patent judges (APJs) of the Patent Office’s Patent Trial and Appeal Board (PTAB) were unconstitutionally appointed, and if so, the remedy for such appointments.  At stake are over 3,000 decisions rendered by the PTAB since its establishment in 2012. Approximately 100 of these decisions are precedential and binding on APJs, meaning that the Supreme Court’s decision has potential to bring about a metaphorical tectonic shift in the jurisprudential landscape created by the PTAB.

by  Allan Lengel   The U.S. Court of Appeals in Cincinnati has revived a legal battle between DTE and a retiree who alleges in a federal lawsuit that the company misled her about her pension plan, resulting in a potential loss of more than $1,000 a month.   The court, addressing what is expected to be a class action lawsuit representing potentially hundreds of employees, ruled 3-0 late last month that Leslie Nolan s lawsuit has merit. The ruling overturns a 2019 dismissal of the case in U.S. District Court in Detroit and directed the lower court to proceed with the case that alleges DTE misled Nolan and breached its pension promises.

Young is charged with failing to register as a sex offender. Young, a resident of Florida, was found to be living in Sandusky, OH, and did not registered as a sex offender with the Erie County Sheriff’s Office, according to the press release from the Federal Marshal’s office.
