LOS ANGELES, Jan. 12, 2021 /PRNewswire/ Former employee of Kingsburg trucking company Cheema Transport, Inc., Steven Blount has filed a lawsuit alleging he was illegally overworked, then fired for speaking up to his manager. Knowing the safety risks involved, Blount alleges management insisted he keep driving past the 11 hour daily limit, as regulated by the Federal Motor Carrier Safety Administration. Mr. Blount started pushing back against his manager s policies in February of 2019, the complaint states, and received abusive and racialized language in return, and was ultimately terminated in June of 2019.
In the lawsuit, Mr. Blount states that in order to avoid drawing the attention of federal regulators, his manager would alter Mr. Blount s electronic logbook to conceal the driving done beyond 11 hours each day. Beginning in or around February 2019, Mr. Blount, struggling with serious back pain that became aggravated upon sitting too l
The federal electronic logging device mandate has leveled the playing field among motor carriers and reduced driver hours-of-service violations, but it may still be too early to determine how ELDs have affected safety on the nation’s roadways, industry experts said.
The regulation, which took full effect just over a year ago, requires nearly all long-haul carriers to record drivers’ HOS data with ELDs instead of paper logbooks, which are more susceptible to errors or falsification.
“I do feel the playing field is more equal now among all carriers as to everyone’s ability to properly handle loads,” said Shawn Brown, vice president of safety for Cargo Transporters. “I think ELDs are making the roads safer. Drivers seem to be resting when they should, resulting in more refreshed drivers on the roads.”

Plenty carriers have found themselves unpaid for loads they hauled for a broker or freight forwarder that has gone broke or, in some rare cases, had no intention to pay to begin with. Sometimes they can still receive all or a portion of the unpaid freight bill from other parties responsible for payment.
1. What is the difference between a freight broker and a freight forwarder?
Both must be registered with the Federal Motor Carrier Safety Administration. While they often operate in similar ways, their legal responsibilities differ. A broker serves as an intermediary between the shipper or receiver and the motor carrier hauling the load. A broker is not liable for loss or damage to the freight and thus most often does not carry cargo insurance.
For starters, a shift in power in Washington will likely alter the regulatory and legislative landscapes. Congress is due to pass a highway bill, with the FAST Act’s expiration last month. DOT and FMCSA will see new leaders. Major court cases involving laws that restrict owner-operators in California and potentially other states will take their next steps. Also, 2020 s freight and rates rally will find fresh hurdles.
Here’s what to watch for in the year ahead:
A proposed rule to mandate speed limiters, which was halted in 2017 after President Trump took office, could be revived under the Biden Administration.
