New Delhi: The Supreme Court on Thursday held that stopping content having attributes of hate on television is as vital as arming policemen with lathis and installing barricades to contain the spread of violence during riots.
A bench headed by Chief Justice S.A. Bobde and comprising Justices A.S. Bopanna and V. Ramasubramanian told Solicitor General Tushar Mehta said control over certain kind of news, which agitate people and may lead to violence or may trigger riots, is essential.

‘People can take any tone on TV as long as they don’t incite violence, hatred, communal riots,’ says CJI Sharad Bobde The Supreme Court on Thursday said stopping hate on television was as essential for law and order as arming policemen with lathis and putting up barricades to prevent the spread of violence and riots.
“Control over certain kind of news which agitate people to violence and riots is a law and order problem. Preventing it is as powerful as putting up barricades. Preventing instigation is as important as providing lathis to policemen,” Chief Justice of India Sharad A. Bobde, heading a three-judge Bench, addressed Solicitor General Tushar Mehta, appearing for the Centre.

I think I deserve a round of applause. Actually, a big round of applause! Last evening, the advertising and media website of a pink daily, ran an anchor story saying, “ASCI bans surrogate advertising of 12 liquor companies”. It was music to my years. I have, over the past three years, waged a lonely battle against surrogate ads, and tried really hard to get the advertising industry watchdog, the Advertising Standards Council of India (ASCI) to rein in these liquor brands masquerading under different surrogates, mostly notional, and only created to cleverly (and deviously) circumvent the law. Despite all my persuasive writings, and much protestations on surrogate advertising, ASCI either turned a deaf ear or tried to evade/obfuscate the issue.
